Ex-MRT contractor barred from future gov't projects, DOTr says

MANILA - (UPDATED) Shareholders of the former maintenance contractor of the MRT-3 are disqualified from bidding for government projects, the Department of Transportation said Tuesday.

The DOTr belied reports that the shareholder companies of Busan Universal Rail, Inc (BURI) will be allowed to bid for 3 railways projects as these firms have already been blacklisted.

"BURI and its joint venture members, which include Busan Transportation Corporation (Busan) and Edison Development and Construction (Edison), are DISQUALIFIED from participating in the bidding of government projects," the DOTr said in a statement.

"Under the Uniform Guidelines for Blacklisting of Contractors, after termination of a contract due to the fault of the contractor, the erring contractor shall be barred from participating in the bidding of all government projects," the DOTr added.

On Monday, PBA party list Rep. Jericho Nograles was quoted in a news report as saying that Busan and Edison had submitted bids for the rail replacement project for MRT-3, the maintenance contract for LRT-2, and the restoration of four LRT-2 trains.

The DOTr, however said that "Busan and Edison's submission of a bid for a project does not mean that they are qualified."

"Pwede po silang mag-submit ng mga dokumento nila, ngunit siyempre yung mga sina-submit nilang dokumento ay subject po sa evaluation ng ating bids and awards committee," DOTr Asec. Timothy John Batan told radio DZMM.

(They can submit their documents, but these will be subject to the evaluation of the bids and awards committee.)

"Kapag na-terminate ka sa kadahilanang kasalanan ng contractor o supplier mo, sila po ay pinagbabawalan nang sumali sa kahit ano pang bidding ng gobyerno," Batan continued.

(When you are terminated because you are a contractor or supplier who is at fault, you are no longer allowed to bid for any government project.)

Last November, the government terminated BURI's maintenance contract for the MRT-3 citing "poor performance and breach of contractual obligations."

Transportation Secretary Arthur Tugade had blamed BURI for the numerous glitches that hit the MRT earlier this year.

BURI however said it was the DOTr's fault that the glitches happened.
