MANILA - Incoming Muntinlupa City Rep. Ruffy Biazon asked the Sandiganbayan to dismiss his graft, malversation and direct bribery cases in connection with his alleged involvement in the pork barrel scam.Biazon is accused of pocketing P1.9 million of public funds after diverting P3 million worth of his Priority Development Assistance Fund (PDAF) to alleged fake organization Philippine Social Development Foundation Inc. (PSDFI) when he was district representative in 2007.Businesswoman Janet Lim Napoles allegedly owned and controlled PSDFI, the chosen &quot;project partner&quot; for livelihood projects in Muntinlupa City that failed to deliver the intended assistance to beneficiaries.In a motion, Biazon stated that there are two types of legislators involved in the pork barrel scam -- a participating legislator and a victim legislator. He said he is among the victim legislators, insisting that he was unaware of the actual disbursement of his PDAF.&quot;Truth being, accused Biazon had no personal knowledge as to the actual disbursement of the PDAF allocations for the Congressional District of Muntinlupa but he knows that projects were really undertaken as he would personally witness the conduct of livelihood trainings and seminars,&quot; the motion read.Biazon questioned why Task Force PDAF only relied on whistleblower Benhur Luy&#x27;s statement, citing that on February 10, 2016, the Ombudsman admitted that they do not have the printout of Luy&#x27;s daily transaction record which would supposedly show his alleged received kickbacks.He said investigators &quot;gave full faith and credence to the statements of Luy without even seeing the documents.&quot;&quot;How would a reasonable and prudent mind find probable cause to charge someone in court on the basis of a mere statement of a person without even asking or verifying indeed indeed the said statement may be supported by a competent document?&quot; the motion read.&quot;Bluntly, the Task Force PDAF took the statement of Benhur Luy hook, line, and sinker and did not bother to check if indeed the supposed receipt of P1,950,000.00 as kickback was indeed recorded and if the recordings thereof may be submitted and admitted as competent evidence in court.&quot;Given the lack of documentary evidence, among other factors, Biazon said his graft, malversation and direct bribery cases have no probable cause and should be dismissed.The Sandiganbayan has yet to issue a resolution on Biazon&#x27;s motion.
