Bawal hong magkomento, bawal hong pag-usapan ang kaso kasi siyempre ayaw naman po natin na magkaroon ng mindset ang mga tao,&quot; ani Mawis.&quot;Inherent power of the courts, not only the Supreme Court but any courts to protect itself from undue influence or paninira sa legal processes o &#x27;yung contemptuous conduct,&quot; sabi naman ni Cayosa.Gusto kasi sanang pagbawalan ng OSG ang ABS-CBN at lahat ng mga taong nagsasalita sa ngalan nito na magkomento tungkol sa kaso.Kabilang sa mga inireklamo ng OSG ay ang mga report ng ABS-CBN News at maging mga komento ng mga artista at personalidad.Tingin ni Mawis, kakaiba ang posisyon ng ABS-CBN dahil nagbabalita ito tungkol sa kasong kinasasangkutan ng mismong kompanya.&quot;Mahirap lang po&#x27;yung posisyon ninyo kasi you are engaged in mass media pero at the same time, litigant ho. Eh siyempre kung ano ho &#x27;yung sabihin ninyo, baka ho ma-construe yon na, it might violate the sub judice rule,&quot; sabi ni Mawis.Pero hindi sang-ayon si Cayosa na dapat manahimik na lang ang ABS-CBN at mga personalidad ng kompanya dahil lang may nakabinbing kaso sa Korte Suprema.&quot;Di naman komo meron kayong kaso hindi naman ibig sabihin ay tatahimik ka na. As long as it is fair, it is balanced, it is truthful and without comment, you can actually report on the progress of the case,&quot; sabi ni Cayosa.Nasa Konstitusyon kasi ang karapatan sa malayang kuro-kuro at pamamahayag at karapatan ng taong malaman ang mga nangyayari na hindi maaaring balewalain kapalit ng contempt powers ng Korte sa rules of court.&quot;It is up for the Supreme Court to judiciously balance between contempt and the need to protect the integrity of the court and court processes and constitutional right natin to freedom of expression, freedom of the press at saka &#x27;yung right to information,&quot; dagdag ni Cayosa. Paliwanag pa ni Cayosa, sa ibang bansa nanggaling ang konsepto ng sub judice rule kung saan may miyembro ng jury na hindi abogado na kailangang protektahan mula sa impluwensiya ng media.Hindi ganito ang kaso ng mga mahistrado ng Korte Suprema.&quot;Mga puro abogado &#x27;yung mga huwes, alam nila &#x27;yung batas, rules of court. So kahit bola-bolahin o may pressure... they are trained not to listen to that and focus on the evidence at hand,&quot; giit ni Cayosa. Gayunman, nagkakaisa sina Mawis at Cayosa na walang dapat ikabahala ang Senado at Kamara kung maglabas man ng gag order ang Korte Suprema.&quot;Ako naniniwala naman that the Supreme Court will be the first to honor and respect the independence ng 3 co-equal branches of government. I don’t think ang Supreme Court manghihimasok &#x27;yan at pipigilan ang Kongreso,&quot; ani Cayosa. &quot;Iba naman ho &#x27;yung sa Senado, kasi kapag ayaw nilang iparinig &#x27;yung mga usapin, meron silang tinatawag na executive session. So wala naman hong executive session ang hearing, open po to the public, maski ho &#x27;yung Senado mismo ang nag-a-allow po sa inyo to be there, to report and witness what is happening,&quot; ayon naman kay Mawis. Ang mas mahalaga, ayon kay Cayosa, ay agad maresolba ng Korte Suprema at ng Kongreso ang isyu ng prangkisa ng ABS-CBN, na nakatakdang mapaso sa katapusan ng Marso.
