MANILA - Former top officials of Philippine Aerospace Development Corporation (PADC) were found guilty by the Sandiganbayan of selling aircraft parts at a low price, which caused a huge loss for the government in 2007.Former PADC president Danilo Crisologo and senior vice president Roberto Manlavi were sentenced to 6 to 10 years imprisonment by the anti-graft court&#x27;s 3rd Division for selling PADC aircraft spare parts, accessories and equipment at a loss to Wingtips Parts Corp. without the required 30 percent mark-up.The total acquisition cost for the spare parts, which included a filter, gasket, seal, compensator, rivets, frame and strobe beacon was P5.76 million but with the pricing policy of PADC requiring the mark-up, the amount should have been P7.49 million.“Their concerted acts gave unwarranted benefits, preference and advantage to Wingtips because it was able to exclusively purchase the subject aircraft spare parts at an unreasonably low cost without any factual or legal basis,” the court said in the decision promulgated on Nov. 29, 2019.The decision was penned by Presiding Justice and Division Chairperson Amparo Cabotaje-Tang, with the concurrence of Associate Justices Bernelito Fernandez, and Ronaldo Moreno.In his demurrer to evidence for the outright dismissal of the case, Crisologo said the spare parts were obsolete or nearing obsolescence as the airline industry is a sophisticated industry with many competing brands and with “fast-paced updates.”The court, however, was not persuaded as a witness testified that the spare parts were considered brand new items, having remained in the PADC stockroom from the time of acquisition.Manlavi also tried to convince the court that new guidelines were set for the determination of the selling prices.“To be sure, there is nothing from the records of this case that will show how the said new guidelines were arrived at,” the court said.Aside from imprisonment, the two were also perpetually disqualified to hold public office.
