What study vs experience say</a></span></div><p>OFW Party List Representative Marissa &quot;Del Mar&quot; Magsino has filed House Bill No. 10206 or An Act Instituting A Property Regime for Cohabiting Same Sex Partners and for Other Purposes.</p><p>The bill states that in the absence of any written agreement, same-sex partners shall be deemed as co-owners of all properties acquired during their cohabitation and all the income generated, the exemptions being properties that are inherited or donated to one of the partners. </p><p>The period of cohabitation shall be established with useful testimonial and/or documentary evidence.</p><p>“Though through the years there has been change in the mindset of people on long-standing stereotypes and generalizations with social perceptions becoming more accommodating of the LGBTQ+ community, there’s still no legislation that guarantees equal rights for everybody regardless of sexual orientation or gender identity,&quot; Magsino said in a statement.</p><div><a href="https://news.abs-cbn.com/news/12/26/23/lgbt-committee-welcome-but-lacks-inclusivity-groups">READ: LGBT committee welcome but &#x27;lacks inclusivity&#x27;: groups</a></div><p>The proposed law covers, among others, the acquisition, ownership, enjoyment, distribution, and disposition of both real and personal property acquired during the partnership.</p><div><span data-darkreader-inline-bgcolor="" data-darkreader-inline-color="" id="isPasted" style="color:rgb(65, 65, 65);letter-spacing:normal;orphans:2;text-align:left;text-indent:0px;text-transform:none;widows:2;word-spacing:0px;-webkit-text-stroke-width:0px;white-space:normal;background-color:rgb(255, 255, 255);text-decoration-thickness:initial;text-decoration-style:initial;text-decoration-color:initial;float:none;--darkreader-inline-color:#bfb9b1;--darkreader-inline-bgcolor:#181a1b;display:inline !important">&quot;By enacting the Same Sex Partners Property Relations Act, we affirm their inherent right to property ownership and management,&quot; Magsino said.</span></div><p>Under the bill, partners in a same-sex relationship will have joint rights to administer and enjoy co-owned properties, giving provisions in cases of incapacity or inability to administer properties, for the other partner to assume management responsibilities until the situation is resolved.</p><p>House Bill 10206 also covers financial obligations, gifts, loans, and the dissolution of the partnership, ensuring equitable treatment and fair distribution of assets upon termination. </p><p>It also establishes clear guidelines and procedures for handling financial matters, such as specifying the responsibilities of each partner regarding debts and obligations incurred during the partnership.</p><p> “I strongly believe that the passage of this bill is crucial in granting legal recognition and safeguarding the rights of same-sex couples,&quot; the lawmaker said.</p>
