“Verily, the court holds that neither the original information nor the amended information is sufficient as the same did not set forth the specific allegation of every fact and circumstance necessary to constitute the crime of offending the religious feelings through and with the use of information and communications technologies,” said Presiding Judge Zita Marie Atienza-Fajardo.

The case stemmed from the complaint of former Commission on Elections (Comelec) chairperson and Sandiganbayan associate justice Harriet Demetriou, a Marian devotee, on comments Cabading made in a 2020 online show on the supposed apparition.

The complaint noted, among others, that Cabading questioned the supposed oil that exuded from the statue of the Virgin Mary as well as the shower of rose petals.
