Comelec division recommends perpetual disqualification of 5 due to SOCE failure

Five individuals have been recommended by the Commission on Elections division to be “perpetually disqualified” in any public office, due to their failure to submit their Statement of Contributions and Expenditures (SOCE) when they ran for election, twice. 

“As of today, the Commission on Elections First Division has resolved to disqualify five candidates who failed to file their respective Statement of Contributions and Expenditures (SOCE) twice within the prescribed period in the following petitions filed motu proprio by the COMELEC Political Finance and Affairs Department (PFAD),” COMELEC spokesperson Atty. John Rex Laudiangco said in a statement. 

 The five individuals are:

 •    Emilio Viliran Arnaez – who ran as Member of the Sangguniang Panlungsod in Tanjay City Negros Oriental in 2019, and as City Mayor of Tanjay City in the 2022 elections

Arnaez was also ordered by the First Division to file an administrative fine of P15,000 for the first non-filing of SOCE, and another P40,000 for the same offense, the second time.

Arnaez was also ordered to be perpetually disqualified from holding public office.

•    Giovanni Jino Hilario Alcantara twice ran as Member of the Sangguniang Bayan in Cainta Rizal in 2019 and 2022 but did not file his SOCE.

He received a fine of P10,000 and P20,000, respectively for the said offenses, along with the administrative penalty of perpetual disqualification from holding public office.

Also disqualified from holding public office for life are:

•    Luisito Castillo Angeles – ran as Member of Bocaue, Bulacan’s Sangguniang Bayan in the 2007 and 2013 elections.

He was ordered to  pay the administrative fine of P2,000 and P20,000, respectively.

•    Ma. Brenda Pajanustan Amosco – ran as Sangguniang Bayan Member in Arteche, Eastern Samar in 2013 and 2022 elections. She was ordered to pay a fine of P10,000 and P20,000, respectively, for the two offenses.

•    Gene Tomas Alamani – ran as Sangguniang Bayan Member in Dinalungan, Aurora in 2010 and 2022. He received a fine of P2,000 and P20,000 for failing to file his SOCE, twice.

Laudiangco said the parties concerned can still file a Motion for Reconsideration before the COMELEC First Division and up to the Commission en Banc.

The said parties can also seek a restraining order from the Supreme Court, he said.
