DOJ to review Alice Guo's plea in trafficking case

MANILA -- The Department of Justice will carefully review the request from the camp of dismissed Bamban, Tarlac Mayor Alice Guo to dismiss the human trafficking case against her.

According to Justice Undersecretary Raul Vasquez, this will be done despite the previous opportunities given to Guo's camp to submit a counter-affidavit.

"Masusing aaralin ng panel yan, ng investigating panel. Pati yung pag reopen nila ng isang issue, whether or not she will be granted an opportunity despite the fact that she was given numerous opportunities to file but for one reason or another, she opted to waste all of them," he said.

(The investigating panel will thoroughly examine that, including the issue of reopening the case. Whether or not she will be granted another opportunity, despite the fact that she was given numerous chances to file but, for one reason or another, chose to waste them.)

"All of a sudden, nung malapit na matapos ang preliminary investigation, ay bigla siyang lumabas at sinabi na as far as she is concerned, she is no longer allowed to file her counter affidavit for her unjustified failure to submit that," Vasquez added. 

(All of a sudden, just as the preliminary investigation was about to conclude, she came forward and claimed that, as far as she's concerned, she is no longer allowed to file her counter-affidavit due to her unjustified failure to submit it.)

The DOJ has previously stated that the NBI will lead the investigation to verify whether Guo truly appeared before a notary public.

"Dati kapag nag-file ka ng counter affidavit, sa harap lang ng prosecutor dapat mag file. Ngayon, sa bagong preliminary investigation rules,it can be before a prosecutor, any person authorized to give oath na ganyan or any notary public for that public, but they have to justify why they do that," said Vasquez.

(In the past, when filing a counter-affidavit, it had to be done before the prosecutor. Now, under the new preliminary investigation rules, it can be done before a prosecutor, any authorized person to administer oaths, or any notary public. However, they must justify why they chose that option.)

When asked whether the notary public will be summoned, Vasquez said, "Titingnan".

In her counter-affidavit, Guo insisted that the documents, such as the electric bill, are not sufficient proof that she was involved in human trafficking.

She argued that the electric bill does not indicate who was actually present at the property and using the electricity where the alleged illegal activities took place.

Guo also asserted that her role as a stockholder in BAOFU does not necessarily mean she was involved in its operations.
