Decision out soon on Alice Guo’s motion to dismiss quo warranto case

MANILA — The Manila Regional Trial Court (RTC) is expected to resolve this month the motion of former Bamban, Tarlac Mayor Alice Guo which seeks to dismiss the quo warranto petition against her.

A quo warranto petition is a legal action that questions the eligibility of a public official to hold his position.

In a message to ABS-CBN News, Solicitor General Menardo Guevarra said Guo’s lawyer filed her motion to dismiss in August. Gueverra’s office immediately filed its comment or opposition.

The RTC heard the motion last August 30.

“If denied, Guo will have to answer the QW (quo warranto) petition,” Guevarra said. “To answer means to submit her written comment. After this the court may conduct hearings.”

Guevarra added it is up to Guo if she wants to testify in court.

The RTC can already render its judgment after the hearings, according to the Solicitor General.

The dismissed mayor’s camp has not yet given a comment.

The OSG filed the quo warranto against Guo in July 29.

Guo reportedly left the country in July and has still not been found. Authorities believe she is in Jakarta, Indonesia.
