<p>MANILA - A Quezon City court has dismissed Atty. Manases Carpio’s petition to stop the enforcement of a subpoena for his income tax returns, which was issued by the House panel that looked into the impeachment complaints against his wife, Vice President Sara Duterte.</p><p>In a five-page order dated May 6, 2026, the QC Regional Trial Court Branch 81 dismissed Carpio’s petition for prohibition for “lack of jurisdiction”, and denied his prayer for the issuance of a writ of preliminary injunction.</p><p>Presiding Judge Madonna Echiverri said the subpoena issued by the respondents, who acted in their capacity as part of the House Committee on Justice (HCOJ), were in the “valid exercise” of the panel’s “inherent power”.</p><p>“… respondents do not usurp, but are in fact, as members of HCOJ are, by law, constituted to determine the sufficiency of the impeachment complaint against the Vice President and eventially the determination of probable cause for the filing of the case to the Senate,” the order explained.</p><p>“To enjoin the public individuals in the performance of their duty in the determination of the sufficiency of the impeachment complaint is to prevent said body to exercise its quasi-judicial or ministerial functions,” it added.</p><p>The order further stated that the Supreme Court has jurisdiction to conduct a “judicial review to determine whether or not there has been grave abuse of discretion amounting to lack or excess of jurisdiction” on the part of any branch of government.</p><p>“… the respondents acted in the official capacity as part of the HCOJ, a co-equal branch of the government, hence, the case at bench should have been filed with the Supreme Court,” it said.</p><p>Carpio, in his petition, said the House panel has no jurisdiction over him and his law firm, since they are not parties to the impeachment proceedings against the Vice President. He added that enforcing the subpoena violates their right to privacy, the confidential nature of tax returns, the Data Privacy Act, and their right against illegal search.</p><p>Last month, the House Committee on Justice voted to keep the box containing the ITRs sealed, amid possible legal issues. </p><p>It decided to transmit the sealed box to the Senate if the impeachment case against Duterte reaches trial.</p><div><br/></div><div><em><strong>ERRATUM: </strong>The previous version of this story, titled &quot;QC court junks bid to stop Duterte impeach proceedings&quot; was unpublished for its factual inaccuracy.
