MANILA — The Supreme Court En Banc has approved the Rule on Family Mediation for the facilitation of family disputes to reduce court backlogs and promote the best interests of the child, among others.

The rule is limited to suits between spouses, parents, and children, other ascendants and descendants, siblings, and relatives within the fourth civil degree of consanguinity or affinity.

It covers issues under the Family Code such as support and custody, settlement of estates without a will, and other civil cases where mediation is allowed.

The court also stressed that the mediation period of 30 days must be strictly observed unless the court approves an extension of not more than 30 days.

Civil cases such as the validity of a marriage or legal separation, habeas corpus cases, and violations under the Anti-Violence Against Women and Their Children Act are among those not covered by family mediation.
