<p>MANILA — The Sandiganbayan rejected Pharmally official Mohit Dargani’s plea to travel outside the country as he faces a graft charge over the alleged overpriced sale of COVID-19 medical supplies.</p><p>In a Nov. 7 resolution, the anti-graft court’s Fifth Division questioned the necessity of Dargani’s 18-day trip to Spain, Germany, and Thailand, ruling that it was “routine, could have been conducted remotely, or was purely for leisure.”</p><p>Dargani earlier asked the court’s permission to travel from Nov. 10 to 28, 2025, to undergo a routine medical check-up, visit his family, and attend the wedding of his cousin.</p><p>He also cited plans to participate in a trade fair and business meeting abroad.</p><p>The court, however, dismissed these reasons as insufficient to &quot;override the potential flight risk posed by the pending criminal case.” </p><p>It added that Dargani’s possession of both Filipino and Spanish passports increased the likelihood of evasion should he be allowed to leave the country.</p><div><a href="https://www.abs-cbn.com/news/nation/2025/10/13/remulla-orders-withdrawal-of-unarraigned-pharmally-cases-in-sandiganbayan-1930">Remulla orders withdrawal of unarraigned Pharmally cases in Sandiganbayan</a></div><p>“In sum, the court maintains that it must prioritize the efficient administration of justice over the accused&#x27;s mere personal convenience… Coupled with the material non-disclosure of his dual citizenship and the attendant flight risk, the court cannot be assured that the accused will faithfully comply with the condition of his provisional liberty and return as promised,” the court stated in its resolution.</p><p>“It bears to stress that holding a Spanish passport grants the accused access to all countries that are members of the European Union without the impediment of securing a visa; significantly increasing his mobility and capacity for flight,” it added.</p><p>The court said Dargani was not able to prove a medical need so urgent that it could only be addressed abroad.</p><p>“As correctly argued by the Prosecution, accused failed to show that he suffers from a rare or critical illness that cannot be competently diagnosed, treated, or managed by the medical professionals and facilities available in the Philippines. The claim that medical check-ups in Spain are covered by their national health insurance, while a matter of convenience, does not constitute an indispensable necessity to override the court&#x27;s jurisdiction,” it said.</p><p>The court also found Dargani’s plans to attend his cousin’s wedding in Thailand a matter of personal leisure or convenience and &quot;in no way indispensable to the life or liberty of the accused.&quot;</p><p>It added that Dargani failed to show why virtual or proxy attendance at the fair and meeting would not suffice.</p><p>“Accused failed to provide the specific purpose for attending the Medica Trade Fair in Germany and the need to be present therein.
