Mark Demayo, ABS-CBN News/File</div>MANILA – The House of Representatives on Monday approved on third and final reading a measure providing an additional ground for cancelling a candidate’s certificate of candidacy, just as it made the acts of a nuisance candidate an election offense.Lawmakers voted 193-4-0 for House Bill No. 11317.The bill amended the definition of a nuisance candidate, which now includes “those who have filed certificates of candidacy for money, profit, or any other consideration.”According to the proposed measure, Commission on Elections, after due notice and hearing, may cancel the certificate of candidacy if this was also filed by “any other circumstances or acts which clearly demonstrate that the candidate has no bona fide intention to run for the office for which the certificate of candidacy has been filed and thus prevent a faithful determination of the true will of the electorate.&quot;The bill also included the following in the list of a candidate’s prohibited acts:- Putting the election process in mockery or disrepute; - Maliciously or deliberately causing confusion among voters by similarity of names; - Obtaining money, profit, or any other consideration; or - By doing any act demonstrating that the candidate has no bona fide intention to run for office;Those found guilty will be penalized with a P500,000 fine, based on the bill.Kabataan Party List Representative Raoul Manuel, who voted in the negative, said the risks carried by the measure outweigh the benefits.“Ang mga kandidatong galing sa mahihirap na pamilya, coming from less privileged backgrounds, pati yung mga galing sa mga relatively less established parties o kahit yung mga tumatakbong independent, sila ay disadvantaged sa napaka-uneven na playing field sa pulitika sa ating bansa,” Manuel said.The lawmaker said there was also a danger in imposing heavy penalties on candidates considered by Comelec as “nuisance.”Candidates with human rights violation records, considered abusive, and those coming from religious groups that only push their own interests should also be called as a nuisance, he said.“In fact nagkaroon ng aberya sa kung paano tinuturing ng Comelec na nuisance ang isang kandidato…Mas marami ang karapat dapat na ma-disqualify dahil hindi sila nasasama sa pamantayan ng Comelec sa pagiging nuisance candidate,” he said.“Sino ba ang mga dapat patawan ng mga mabibigat na penalties? Andiyan ang mga kandidatong hindi nagdedeklara nang maayos ng kanilang campaign expenses, yung mga sinasadyang tinatago ang kanilang sources of funding at kung magkano ang natira sa kanilang  nakuhang donation sa kanilang campaign,” the lawmaker said.
