Duterte Youth files petition before SC challenging Comelec's suspension of its proclamation

MANILA (UPDATED) – Duterte Youth Chairman Ronald Cardema on Tuesday filed a petition before the Supreme Court challenging the decision of the Commission on Elections, sitting as National Board of Canvassers, to suspend the proclamation of the group.Cardema filed a petition for certiorari with Urgent Prayer for Temporary Restraining order and/or Writ of Preliminary Mandatory Injunction. It seeks to declare unconstitutional and contrary to law the NBOC resolution dated May 18,2025 suspending the proclamation of Duterte Youth. The petition also asks the SC to issue a TRO and/or writ of preliminary mandatory injunction on the same NBOC resolution to compel Comelec to proclaim Duterte Youth as one of the winning party-lists of the 2025 elections.&quot;Tayo po ay nag-file ng petition for certiorari. Nagpapa-TRO po tayo doon sa ginawa ng Comelec. Sa tingin po natin, merong grave abuse of discretion ang Comelec kahapon,&quot; he told reporters after the filing.&quot;Sinabihan lang kami na hindi kami kasama sa proclamation tanghali, bago mag-proclamation mismo. Kung sinabi nila last week yun, eh di nagawan namin ng paraan. Pero parang sinadya, tatlo, apat na oras bago ang proclamation saka kayo magsasabi na di kayo kasali,&quot; Cardema added.Comelec Chairman George Garcia earlier said they informed first the party-lists and gave them a copy of the NBOC resolution before it was announced during the proclamation ceremony Monday afternoon.<div><a href="https://www.abs-cbn.com/news/nation/2025/5/19/comelec-says-issue-with-duterte-youth-bh-party-list-resolved-before-20th-congress-opens-0006">Comelec says issue with Duterte Youth, BH party-list resolved before 20th Congress opens</a></div>Garcia said the proclamation of Duterte Youth and Bagong Henerasyon Party-list was suspended due to pending disqualification petitions. Cardema laid out the reasons why they believe the Comelec committed grave abuse of discretion, citing their group was voted by over 2.3 million voters in the 2025 midterm elections.  &quot;Discretion na lang pala ng Comelec ngayon kung kailan sila magproproklama ng duly elected winners sa election,&quot; Cardema said.&quot;Bakit sasabihin ng Comelec nang dahil sa 2019 na kaso very serious daw yun, very grave, i-hohold yung proclamation? Existing na yung haoshiao na kasong yun noong 2019 pa pero binigyan tayo ng proclamation for the 2019 elections. Nung 2022, existing parin yung 2019 na kaso yun pero pinasali tayo at binigay tayo ng proclamation,&quot; he said.Cardema asked why the Comelec acted differently.&quot;Bakit ngayon, kung kailan tayo ang nasa taas, tayo ay magkakaroon ng three seats, bakit biglang sasabihin very serious yung mga kasong yun? Very serious pala, bakit yung last hearing natin 2019 pa?&quot; he said.In a Teleradyo Serbisyo interview, Garcia said he was not aware of the issue when he became Comelec chairman in 2022.  &quot;Maganda rin na napaalala ngayon &#x27;yung kaso na &#x27;yan at siguro naman naniniwala ako kahit &#x27;yung party-lists na &#x27;yan mas gugustuhin nila na magkaroon na ng final na resolusyon &#x27;yung issue,&quot; Garcia said.Cardema said they attached an annex in the petition, which is a Supreme Court en banc notice dismissing an earlier petition against them.The former National Youth Commission Chairman said the Comelec might not have seen the document. &quot;Yung mga petitioners na nag-file ng kaso sa Comelec noong 2019, dahil re-releasean na kami for the 2019 elections noon ng certificate of proclamation, ang ginawa nila pumunta sila sa Supreme Court. Finile nila yung same allegations. Ang ginawa ng Supreme Court dinismiss ng Supreme Court, wala daw basis yung sinasabi ng same petitioners na yun,&quot; he said.Cardema claimed the petitioners resurfaced the previous cases when they saw the party-list&#x27;s ranking in the partial, unofficial count.&quot;Finile-an kami ng vote buying. Bakit daw? Kasi nag-speech daw ako noong 2019, sinabi ko pag nanalo Duterte Youth Party-list, lahat ng aming pondo ay ibibigay namin sa taong bayan,&quot; he said.&quot;Isa pang kaso nila, sabi ko daw sa isang speech ko, kapag nanalo Duterte Youth Party-list, dedebathin namin kayo hanggang maubos kayo,&quot; Cardema said.SC spokesperson Camille Sue Mae Ting explained the process when a petition includes a prayer for TRO.&quot;If your petition includes a prayer for TRO, that’s considered urgent.
