MANILA — Losing candidates have 10 days from proclamation to file their electoral protests with the Commission on Elections and these should include sworn affidavits.

“Kinakailangan kung may akusasyon ka, suportahan mo naman ng affidavit, otherwise magiging general allegations ‘yon which is a ground to dismiss,” Comelec Chair George Garcia said.

(If you have an accusation, you have to support it with an affidavit, otherwise these are just general allegations, which is a ground to dismiss)

JURISDICTION OVER ELECTORAL PROTESTS

Garcia said Comelec will have jurisdiction over electoral protests for the following positions:

  1. Governor
  2. Vice Governor 
  3. Sangguniang Panlalawigan Member
  4. City Mayor 
  5. City Vice Mayor
  6. City Sanggunian Member

Election protests on the municipal level should be filed before the Regional Trial Court.

The House of Representatives Electoral Tribunal and the Senate Electoral Tribunal will handle electoral protests for members of Congress.

PETITIONER, PROCLAIMED CANDIDATE PAY COSTS OF PROTEST

Garcia admits it is not cheap to file an election protest and that petitioners and respondents will have to spend a lot of money.

Costs include:

  1. Deposits for each ballot box
  2. Transport to bring the ballot boxes to Manila
  3. Warehousing of the ballot boxes (Petitioner pays)
  4. Committee allowance

Garcia said he expects an influx of protests on Thursday, the last day to file protests over the May 12 elections.
