Remulla assures Timor-Leste conditions on Teves deportation will be met

MANILA — Justice Secretary Jesus Crispin Remulla assured the government of Timor-Leste that the conditions it set on the deportation of former Negros Oriental Rep. Arnolfo Teves, Jr. will be met.

In the certificate of handover signed by Philippine and Timorese officials, the Philippine government was informed that Teves cannot be sentenced to death, a punishment no longer imposed in the Philippines.

“Even if it were to be reinstated, it could not be imposed in this case, as it cannot be applied retroactively,” the Timor-Leste government said in the certificate.

“Wala naman talage eh (We really don't have that), we don’t do that, it’s not state policy,” Remulla said.

Other conditions set in the certificate of handover include guarantees against torture, inhuman or degrading treatment or cruel punishment.

The Timorese government also asked the Philippine government to observe due process throughout the criminal proceedings.

“I think it was just a document that they needed to assure that they were doing the right thing but it was really unnecessary because we have a more advanced legal system than Timor-Leste, a more mature one,” Remulla said.

With Teves on Philippine soil, Remulla said the expelled lawmaker will be arraigned soon by the Manila Regional Trial Court, where he is facing multiple murder cases for the killing of Negros Oriental Gov. Roel Degamo and nine others.

“Ongoing na ang kaso eh, ise-set lang ng court yan, authorities have the obligation to bring him to court for arraignment, so that the court can acquire jurisdiction over his person,”  Remulla said.

Remulla also noted that the freeze order against the assets of Teves, because of the declaration of the Anti-Terrorism Council that he is a terrorist, remains.

“Ang terrorism kasi is a continuing crime that’s why in the case of Teves, the resources might be used to do the same thing all over again in the country, its something that was done with all the facts in front of the Anti-Terror Council,” Remulla said.
