MANILA —  The Office of the Ombudsman has ordered some high-ranking officials tagged in former President Rodrigo Duterte’s arrest to file counter-affidavits, a document released on Tuesday showed. 

The Ombudsman’s order stemmed from Sen. Imee Marcos' request for the Ombudsman to probe officials involved in Duterte’s arrest by the International Police in March. She said the officials could be liable for graft, grave misconduct, usurpation of judicial functions, and arbitrary detention, among others. 

Those ordered to respond to the criminal and administrative charges were Justice Secretary Jesus Crispin Remulla, police Criminal Investigation and Detection Group Chief Maj. Gen. Nicolas Torre III, Interior Secretary Jonvic Remulla, Philippine National Police Chief Gen. Rommel Marbil, and Special Envoy for Transnational Crime Markus Lacanilao. 

"Failure to file Counter-Affidavit within the aforesaid period shall be deemed as waiver of respondents' right to submit controverting evidence and the preliminary investigation shall proceed accordingly," the document reads.

The respondents were ordered to submit the counter-affidavit together with the affidavit of their witnesses, and other supporting documents within 10 days from the receipt of the order. 

The officials have stood by the government's actions on the former President's arrest and denied "kidnapping" accusations by the Duterte camp.

Duterte, 80, faces a charge of crimes against humanity for murder over his "war on drugs" that claimed the lives of thousands of mostly poor men, often without proof they were linked to drugs.

A confirmation of charges hearing, where prosecutor and defense first lay out their evidence, is currently scheduled for September 23.
