Remulla questions Ombudsman probe on Duterte arrest

MANILA — Justice Secretary Jesus Crispin Remulla questioned Wednesday the procedures of the Ombudsman but at same time assured that he would file his counter-affidavit on the arrest and transfer of former president Rodrigo Duterte to The Hague.

“Hindi lang clear talaga ang procedure ng Ombudsman. Anyway, we will still answer it,” Remulla said. 

“Parang hindi malinaw ang procedure kasi dati, merong fact-finding iyan, may rules na published iyan. Iyong ngayon parang hindi rin dumaan sa fact-finding, basta dere-derecho kaagad sa amin,” he added.  

Remulla reiterated that authorities did not violate any laws during the arrest and transfer of Duterte to the International Criminal Court.

“Sasagutin namin ang bawat issue, na everything that happened was within legal bounds, lahat naman iyan according to law,” Remulla said.

He also criticized the complaint filed by Sen. Imee Marcos before the Ombudsman.

“It’s actually the complaint itself, parang na-weirdan ako, hindi naman committee report eh. Why the haste? Why not wait for the committee report kasi that’s the committee investigation? What was contained was the chairman’s report, that’s a little strange,” Remulla said.

He questioned the timing of the filing of the complaint. 

“Pag tapos na ang eleksyon tapos na iyon, kasi parang in aid lang iyan, gusto lang talaga makakuha ng publicity tungkol sa eleksyon, wala tayong magagawa,” he said.

Sen. Marcos earlier said several officials could be liable for graft, grave misconduct, usurpation of judicial functions, and arbitrary detention, among others, for Duterte’s arrest.

Aside from Remulla, those ordered by the Ombudsman to respond to the criminal and administrative charges were police Criminal Investigation and Detection Group Chief Maj. Gen. Nicolas Torre III, Interior Secretary Jonvic Remulla, Philippine National Police Chief Gen. Rommel Marbil, and Special Envoy for Transnational Crime Markus Lacanilao. 

The officials have stood by the government's actions on the former President's arrest and denied "kidnapping" accusations by the Duterte camp.

PNP Chief Gen. Rommel Francisco Marbil said they merely assisted the Philippine Center on Transnational Crime (PCTC) in implementing the ICC arrest warrant.

"We will show them na we are within the bounds of the law. We will answer po. Nothing to hide," Marbil said.

Duterte, 80, faces a charge of crimes against humanity for murder over his "war on drugs" that claimed the lives of thousands of mostly poor men, often without proof they were linked to drugs.

A confirmation of charges hearing, where prosecutor and defense first lay out their evidence, is currently scheduled for September 23.
