MANILA — Vice President Sara Duterte's ally Senator Ronald "Bato" dela Rosa said on Tuesday he and other senators do not believe that the 20th Congress can hold the trial of her impeachment that was initiated in the 19th Congress. 

"Based on my readings, based on my research, I am inclined to believe na hindi na pwedeng tumawid sa next congress. ‘Yan ang aking nakikita ah," Dela Rosa told reporters. 

"Hindi ako abogado pero nagre-research ako. Nang pinag-aralan ko, ‘yan ang nakikita ko," he said.

Dela Rosa said other senators share his thinking.

"Marami ring naniniwala na hindi na talaga dapat tatawid. For example, si Senator Tolentino kahapon during his manifestation. Very clear naman ‘yung manifestation niya, ‘di ba? ‘Yung kanyang explanation very clear naman. Hindi lang siya. Marami pa. Marami pang ibang naniniwala," he claimed.

While Dela Rosa believes the Senate does not have to vote on whether to convene the impeachment court or not, he said that the question is whether the Senate has "material time" to do the trial in the 19th Congress —  which ends this month.

"Ang question diyan is ‘yung material time. ‘Yan ang pinaka-issue diyan. But as to whether or not aaksyunan ng Senado, it is incumbent on the part of the Senate to act on that once the articles of impeachment are transmitted to the Senate. Hindi ‘yan pupwedeng hindi aksyunan. Aaksyunan ‘yan. Pero ‘yun nga, ang tanong diyan ‘yung material time kung kakayanin ba within this 19th Congress," he said.

"Kasi kung hindi kakayanin, meron nanamang another issue diyan, kung pwede bang itawid sa next Congress. Madugo na debate ‘yan. Kung pwede bang tumawid o hindi," he added.

Dela Rosa said it will become an unfinished business of the Senate, which will have to be terminated with the expiration of the 19th Congress.

"That’s one of the unfinished business. Whether legislative or other business of the Senate, but still unfinished business dahil nga independent ‘yung 19th Congress from the 20th Congress and vice versa. So kung anong nasimulan nitong 19th Congress, hindi binding ‘yung 20th Congress na ipagpatuloy ‘yung ginawa ng 19th Congress. Kasi they are separate worlds, another Congress, and the question on jurisdiction will come in. Finile ‘yan sa 19th Congress, magiging question diyan is may jurisdiction ba ang 20th Congress na makialam sa impeachment case na finile sa 19th Congress. Malaking question ‘yan at alam ko despite the fact na merong opposing schools of thought, madugo ang kanilang debate," he said.

Senate President Francis Escudero earlier said that any vote by the 19th Congress Senate on what to do with the impeachment is not binding on the next Congress, which will also have the right to vote on its fate.

Seventeen senators of the 19th Congress will be joining the 20th Congress: 12 elected in 2022 for terms to end in 2028 and 5 reelected last month for terms to end in 2031. Seven other winners of #Halalan2025  include 4 former senators who won fresh terms and 3 congressmen who were elected to the Senate.
