<p>MANILA — The Supreme Court may yet reverse its decision on the impeachment of Vice President Sara Duterte, former SC associate justice Antonio Carpio said, adding he believes the ruling was based on factual errors.</p><p>The SC ruled last week that the impeachment proceedings were unconstitutional for violating a bar on initiating more than one against the same official in the same year.</p><p>The House of Representatives has<a href="https://www.abs-cbn.com/news/nation/2025/7/27/house-to-seek-reversal-of-sc-ruling-on-vp-sara-impeachment-1336"> said it will file a motion for reconsideration</a>, which, Carpio said, should lead to oral arguments on the issue.</p><div><a href="https://www.abs-cbn.com/news/nation/2025/7/30/sara-duterte-says-to-stand-tall-vs-greedy-leaders-after-supreme-court-blocks-impeach-trial-1227"><strong>Sara Duterte says to ‘stand tall’ vs greedy leaders after Supreme Court blocks impeach trial<br/></strong></a></div><p>&quot;I am optimistic that... the Supreme Court will decide correctly and they will consider very seriously the motion for reconsideration because there was really a factual mistake,&quot; Carpio said.</p><p>Speaking at the Kapihan sa Manila Bay forum, Carpio and 1986 Constitutional Commission member Christian Monsod said the Supreme Court should reverse its decision since no proceedings had been initiated previously.</p><p>Carpio said the rule should not apply to the fourth impeachment complaint that the House endorsed to the Senate for trial. Three complaints filed before it were archived.</p><p>“So, obviously the one-year-bar rule cannot apply to the fourth complaint, the fourth complaint was filed on time. So it&#x27;s a very basic error there and I think it deserves to be reconsidered by the Supreme Court,&quot; Carpio said.</p><div><br/></div><div><strong>&#x27;RULING SHOULD ONLY APPLY TO FUTURE IMPEACHMENT CASES&#x27;</strong></div><p>Carpio and Monsod also said the Supreme Court&#x27;s new rules on impeachment should not retroactively apply to Vice President Duterte&#x27;s case.</p><p>The SC said in its decision that Duterte&#x27;s right to due process had been violated and that the House should have heard her side before impeaching here and transmitting the articles of impeachment to the Senate.</p><p>Monsod said impeachable officials like Duterte would be heard at the Senate and not at the House of Representatives.</p><p>“That is not contemplated by the Constitution, the due process is observed in the hearings of the Senate not in the meetings of the House of Representatives,” Monsod said. </p><p>Carpio said there were precedent decisions made by the Supreme Court reversing its own unanimous decisions.</p><div><a href="https://www.abs-cbn.com/news/nation/2025/7/27/palace-respects-doesn-t-necessarily-agree-with-sc-ruling-on-vp-sara-impeachment-case-1422"><strong>Palace respects, doesn&#x27;t necessarily agree with SC ruling on VP Sara impeachment case<br/></strong></a></div><p>But even if the high court refuses to reverse its decision, refiling the impeachment complaint after February 5, 2026 is still an option, he said.</p><p>“It’s not the end of the world, after February 5, 2026, the impeachment can be refiled by the House. This is just a delay, that is just about six months, time will pass quickly,” Carpio said.</p>
