Motion for reconsideration over SC ruling on Duterte impeachment case filed by citizen complainants

MANILA — Six of the citizen complainants behind the first impeachment complaint against Vice President Sara Duterte filed on Friday a motion for reconsideration at the Supreme Court (SC) regarding its ruling on Duterte’s impeachment case.They earlier filed a motion to intervene, before the SC made its decision declaring the articles of impeachment unconstitutional, according to Tindig Pilipinas co-convenor Sylvia Claudio.But the SC did not entertain the request, Claudio said.“Kaya ngayong hapon po, magfa-file din kami ng request to file a motion for reconsideration of the decision ad cautelam dahil po naintindihan namin na nagre-request pa po kami ng legal status based on our previous request na makapag-oral arguments with the Supreme Court before they decided. But they had already decided, so we&#x27;re hoping to join others who want to file a motion for reconsideration dahil we disagree po— disagree severely with what the Supreme Court has decided about the impeachment case. We don&#x27;t believe it&#x27;s unconstitutional,” Claudio told the media.<div><a href="https://www.abs-cbn.com/news/nation/2025/8/1/congress-constitutional-authority-over-impeachment-should-be-respected-up-law-faculty-1535">Congress&#x27; constitutional authority over impeachment should be respected: UP Law faculty</a></div>The impeachment case violated the rule against initiating more than one impeachment proceeding against the same official in one year, according to the SC decision.Claudio believes this is false as the first complaint from them did not get referred to the House Committee on Justice.“Hindi naman na-refer to the Committee on Justice even ‘yung first complaint namin. Naniniwala din kami na katulad nung dating nangyayari naman ay ‘yung immediate transmittal to the Senate after the fourth impeachment complaint garnered the right number of endorsements was in order,” Claudio said.For Claudio, the Supreme Court “reversed” the spirit of the Constitution to hold officials accountable, as it focused on technicalities.“We don&#x27;t believe that the factual and processual issues brought on by the Supreme Court are correct. But more importantly po, we don&#x27;t believe that this is the spirit of the Constitution. The spirit of the Constitution is for us to be able to hold our officials accountable. And what the Supreme Court did has reversed that spirit— that we are always looking to the Supreme Court for their wisdom not their formalistic understanding and technicalities,” Claudio said.According to the group behind the motion, Akbayan party-list Rep. Perci Cendaña signed the motion for reconsideration as movant-intervenor.The group is also supportive of Senators Francis Pangilinan, Bam Aquino, Risa Hontiveros, and Vicente Sotto III signing a proposed resolution to push through with the impeachment trial, applying the Supreme Court ruling in future impeachments instead.<div><a href="https://www.abs-cbn.com/news/nation/2025/7/25/supreme-court-duterte-impeachment-articles-unconstitutional-1601">Supreme Court blocks VP Sara Duterte&#x27;s impeachment trial</a></div>“We are in full support of our Senators who, like us, are trying to find more accountability, upholding our Constitution, both the judiciary, the Senate and the legislature. Naniniwala rin naman po kami na medyo sumobra ang decision ng Supreme Court sa dapat gawin at hindi gawin ng ating legislature,” Claudio said.Claudio added, various groups like theirs will hold  mass actions, including one at the Senate on August 6, Wednesday, as this is when the upper chamber is scheduled to tackle the SC ruling.
