The lawyer of the victims in the case against former Philippine president Rodrigo Duterte has asked the International Criminal Court (ICC) Appeals Chamber to grant her a &quot;varying standard time limit&quot; to respond to the defense&#x27;s move to disqualify ICC Chief Prosecutor Karim Khan.In a document dated August 15, 2025, Paolina Massidda, the principal counsel for the victims, said at the time that the defense for Duterte filed its request to disqualify Khan, she did not yet have access to certain documents that formed the basis of the defense request.Massidda said the ICC Pre-Trial Chamber I only granted her access to the said documents on on August 11, or after five days following the submission of the defense request.&quot;Considering the ten days deadline established by regulation 34(b) of the Regulations of the Court to file a response, and, in light of the importance of the matter under litigation for the interests of the victims, the Legal Representative requests the Appeals Chamber to vary the standard time limit for filing her a response so that the relevant time limit starts running from the date of notification of the said documents,&quot; Massidda added.Duterte&#x27;s camp is urging the ICC to disqualify Khan from any further role in the case of the former Philippine president.The Duterte defense team argued that Khan’s former representation of an alleged policy of extra-judicial drug-related killings in the Philippines and his role in the trial of Duterte can be considered as an “irreconcilable conflict of interest”.According to the defense, Khan, as a private lawyer, represented victims of the &quot;war on drugs&quot;, prior to his election as ICC chief prosecutor in 2021.Khan is currently on self-imposed leave due to allegations of sexual misconduct.In June, the Duterte defense team also sought to disqualify two judges hearing the jurisdiction issue in his case before the Hague-based tribunal, which the ICC rejected.Duterte was arrested on March 11  on his arrival from Hong Kong at the request of the ICC as part of its probe into his &quot;war on drugs&quot; that defined his presidency.The ICC warrant for Duterte&#x27;s arrest said that as president, the 80-year-old Duterte allegedly created, funded, and armed death squads that carried out murders of purported drug users and dealers.He was brought to The Hague in the Netherlands on the same day he was arrested.Duterte on March 14 appeared via video link before ICC judges.
