MANILA — The articles of impeachment against Vice President Sara Duterte are dead.This, according to Senator Alan Peter Cayetano, is the effect of their vote to archive the said articles during Wednesday’s session wherein 19 voted in the affirmative, four voted against, and one abstained.<div><a class="fr-green fr-strong" href="https://www.abs-cbn.com/news/nation/2025/8/6/senators-voting-on-marcoleta-motion-to-archive-sara-duterte-impeachment-1906">READ: Senate archives Sara Duterte impeachment case</a></div>He clarified, however, that these can be revived if the Supreme Court reverses its motion which said the articles of impeachment were void from the start, or ab initio.“Ang kaibahan naman ng motion na pinasa natin, in-archive na siya na sinunod ang Supreme Court decision, pinatay na siya. So kung ma-reconsider ng Supreme Court, puwede mong buhayin,” Cayetano said.Senate President Francis Escudero earlier said they can bring out the articles from the archive with a majority vote, but Senate Minority Leader Tito Sotto has reservations about this.“Mahirap nang bunutin &#x27;yun,” Sotto said.Asked if the articles of impeachment are dead, Sotto said, “Hindi naman.”Cayetano also differentiated the motion to archive from the motion to table, which was brought up by Sotto to set aside the motion to dismiss of Senator Rodante Marcoleta.“Yung i-table simpleng salita, isangtabi muna. So meaning buhay siya pero hindi muna dini-discuss. So ang problema, kung ite-table namin yung motion ni Senator Marcoleta, ibig sabihin nun, nandiyan pa, hindi namin ginagalaw, pero nandiyan pa yung case. Labag yun sa sinabi ng Supreme Court na immediately executory. Pero kung isantabi mo, ibig sabihin buhay siya pero pag naging final ang decision, puwede mong patayin,” Cayetano explained.He also said they could not wait until the Supreme Court decides on the motions for reconsideration because of the SC order that their ruling was immediately executory.For Sotto, the fact that the Senate archived the articles of impeachment means they have jurisdiction over these, contrary to what the Supreme Court and several Senators asserted.“Sabi ng SC, walang jurisdiction kahit nag-convene sila, sabi ng mga kasama ko, walang jurisdiction, pero in-archive. Ano ang ibig sabihin noon? &#x27;Di ba may jurisdiction?” Sotto said.
