MANILA - The Department of Justice filed tax evasion raps against controversial contractor Cezarah “Sarah” Discaya before the Court of Tax Appeals.This comes after the department announced it found prima facie evidence &quot;with reasonable certainty of conviction&quot; to file tax evasion charges against the contractor and her spouse, Pacifico “Curlee” Discaya.Sarah is facing four counts of tax evasion corresponding to two taxable years 2020-2021. <div><a href="https://www.abs-cbn.com/news/nation/2026/2/2/boc-to-auction-10-more-discaya-cars-this-february-11-1512">BOC to auction 10 more Discaya cars this February 11 </a> </div>“We say four counts because per each taxable year, two violations per two provisions of the tax code or the National Internal Revenue Code was found,” DOJ spokesperson Polo Martinez said in a briefing Friday, February 6.The provisions pertain to Section 254 or Willful Attempt to Evade or Defeat Tax, and Section 255 or Willful Failure to Supply Correct and Accurate Information.“The information for this case was filed, we report, on Feb. 3, 2026 with the Court of Tax Appeals which has jurisdiction over the offense,” Martinez added. However, the information for Curlee’s case has not yet been filed before the court after he appealed to defer such filing.“Curlee Discaya filed a motion for reconsideration with the deferment of the filing of the information with the panel of prosecutors or should I say just one prosecutor,” the DOJ official explained.<div><a href="https://www.abs-cbn.com/news/business/2026/2/2/doj-excise-tax-cases-vs-discayas-over-luxury-cars-dismissed-1934">DOJ: Excise tax cases vs Discayas over luxury cars dismissed </a> </div>As a matter of procedure, the Bureau of Internal Revenue was asked to comment on the filing.“Until such time the BIR can comment and such time that the panel of prosecutors or that prosecutor can resolve on the basis of these documents, the preliminary investigation is continuing,” Martinez noted.Prosecutor General Richard Fadullon vowed to “resolve the issue” by the coming week.
