DAR resolution on Luisita not yet 'final and executory': Mariano

The resolution released by the Department of Agrarian Reform (DAR) is not final and executory, as options are still open to the parties involved, the department secretary said on Friday.

Secretary Rafael Mariano told ANC's Dateline Philippines he cannot categorically claim that the resolution ordering the distribution of 358.22 hectares of land in Barangay Belete and Cutcut, Tarlac City is effective immediately.

"Hindi pa naman po final and executory yung akin pong resolution. Meron pong options and remedies open to both parties dito po sa usaping ito. Di ko naman po sila pangungunahan," he said.

On Thursday, DAR ordered the distribution of parcels of land owned and managed by the Tarlac Development Corporation-Hacienda Luisita (TADECO).

Mariano emphasized, the said tracts of land are outside the 4,915 hectares of Hacienda Luisita land which were ordered by the Supreme Court in 2012 be immediately distributed by DAR.

The Alyansa ng Manggagawang Bukid ng Asyenda Luisita (AMBALA) filed a petition seeking the coverage of the said properties under the Comprehensive Agrarian Reform Program (CARP).

But Mariano clarified, the land beneficiaries will not only be the petitioning members of AMBALA.

"May proseso ng identification, screening and selection ng potential farmer beneficiaries. Hindi lang masasabi na members lang ng Alyansa ng Manggagawang Bukid ng Asyenda Luisita," he said.

"May process po tayong dadaanan para macomplete 'yung final list ng farmer beneficiaries. so yun yung pinag utos ko sa regional provincial offices ng Department of Agrarian Reform sa probinsiya ng Tarlac," he added.

[We will go through a process to complete the list of beneficiaries. That is what I tasked the regional provincial offices of DAR in Tarlac to do.]

Mariano said some farm worker beneficiaries have already been identified, but they still have to iron out some operational issues.

"Mayroon na pong mga na-install na farm worker beneficiaries, meron pa pong inaayos dito na operational issues na kailangan po nating magawa pa, and then yun pong masimulan na rin po yung audit ng libro ng Hacienda Luisita Inc.," he said.
