Sent money to wrong GCash number?  Here’s how to get it back

Mistakes happen, but it’s so much more painful when they come at a cost to your wallet and no hope of redemption.Last week, a Facebook post proved otherwise and it went viral.  Shared on April Fool’s Day, some netizens took it as a joke, but it was 100 percent real and something we can all learn from if we happen to find ourselves in the same boat.<div>What went down</div>In a public post, Hayden U. Sison shared that his assistant sent P13,000 to a wrong GCash number when she incorrectly keyed in the last digit. “Within 3 minutes of realizing her error, she notified GCash.  The person who received the money blocked her.  GCash says ‘walang magagawa’ (nothing can be done).”Thankfully, the assistant did not give up.  “She emails Bangko Sentral ng Pilipinas and the following day GCash emails her saying they received an email from Bangko Sentral.  GCash returned the money, less a minimal charge.”Good for her and for Hayden and a happy ending we can all virtually toast to.<div>The law is on her side</div>Atty. Alman-Najar Namla chimed in on the online conversation with legal speak the next day.  “GCash initially said ‘wala magagawa.’ That response is unacceptable. Electronic money issuers like GCash are supervised by Bangko Sentral ng Pilipinas (BSP) under Circular No. 649, Series of 2009, and they have a duty to act on disputes, not dismiss them. The sender did the right thing by escalating to BSP, and it worked. GCash returned the money less a minimal charge.”He advised readers to learn this lesson: “If a company regulated by BSP refuses to act, go straight to BSP. The regulator has teeth, and regulated entities move fast once BSP gets involved.”And it’s not just GCash that was in the wrong here, but also the one who got the P13,000 then blocked the assistant.“When you send money to the wrong GCash number, the recipient has no legal right to keep it. Under Article 2154 of the Civil Code, if something is received when there is no right to demand it and it was delivered through mistake, the obligation to return it arises. This is called solutio indebiti.”According to Atty Namla, “the recipient who blocked the sender and refused to return PHP 13,000 is not just being rude. That person may be liable for unjust enrichment under Article 22 of the Civil Code, and possibly even estafa under Article 315 of the Revised Penal Code if the intent to misappropriate can be established.”The lesson to be learned here is that if you somehow receive a GCash credit by mistake, or even a bank deposit for that matter, trying to keep it exposes you to legal risk.<div>GCash airs its side</div>After the story was posted, GCash reached out to ABSCBN News to clarify the “walang magagawa” claim in Hayden’s post.According to GCash, “on the same day the case was reported, our Customer Experience team acknowledged the concern and guided the user through the formal process for requesting assistance. As part of standard handling, we also explained that validation and coordination would be required, which may take time.”GCash also pointed out that “the return of funds is not the result of an automatic system reversal, but typically occurs through successful coordination and the legal obligation of the recipient under solutio indebiti to return money received by mistake.<div>How to reach BSP</div>If you find yourself in a similar situation and need to seek regulatory assistance, note that there are many ways to reach BSP.  In the case of Hayden’s assistant, she sent an email. You could do the same and write to consumeraffairs@bsp.gov.ph.  If you want to speak to someone, the BSP Consumer Assistance hotline is available weekdays from 8 AM to 5 PM via these numbers (632) 5306 2584 or (632) 8708 7087. If you prefer Facebook Messenger, you can use the BSP Online Buddy (BOB) chatbot.BSP’s Consumer Assistance Desk accepts complaints against BSP-supervised institutions, including banks, e-money issuers (GCash, Maya), non-bank financial institutions, and pawnshops.But please note that just like Hayden’s assistant, you need to reach out to the concerned party first, in this case, the recipient who received the funds incorrectly or GCash.  You must first attempt to resolve the issue directly with GCash, or your bank or financial provider.  If the financial institution&#x27;s final decision is unsatisfactory, or you get a “walang magagawa” comment, then you can escalate to the BSP through the channels above.  Here’s hoping you will get a fair resolution and your funds will flow back to your account.<div>Editor&#x27;s Note: We revised the article after feedback from GCash to include their side.</div>
