Eli San Fernando, National Federation of Labor legal counsel Minister Moises Du and other labor groups filed before the Supreme Court a petition for certiorari and prohibition against the issuance of a Pasig City court of a Temporary Restraining Order against the P85 wage hike in the National Capital Region.</p><div><a href="https://www.abs-cbn.com/news/business/2026/8/11/akbayan-labor-activists-urge-sc-to-probe-pasig-court-s-tro-vs-wage-hike-1132" rel="noopener noreferrer" target="_blank">Akbayan, labor activists urge SC to probe Pasig court’s TRO vs wage hike</a></div><p>Also joining the petition are Workers and Peasants’ Party of the Philippines, UNI Global Union-Philippine Liaison Council, Unified Filipino Service Workers, Federation of Free Workers, Partido Manggagawa, Sentro ng mga Nagkakaisa at Progresibong Manggagawa and Council of Teachers and Empoloyees in Schools, Colleges and Universities in the Philippines.</p><div><a href="https://www.abs-cbn.com/news/business/2026/8/10/workers-rising-costs-cannot-wait-for-litigation-on-wage-hike-labor-lawyer-2317" rel="noopener noreferrer" target="_blank">Workers, rising costs cannot wait for litigation on wage hike — labor lawyer</a></div><p>Manibela Chairperson Mar Valbuena also joined the labor leader in a short program outside the Supreme Court.</p><p>“So ang gusto kasi natin pumasok na ang Supreme Court at magbigay ng guidance sa mga judges at sa mga lawyers sa kung paano ba iti-treat itong kaso ng paglalabas nga ng TRO sa dagdag sahod,” San Fernando said.</p><p>The group invoked Article 126 of the Labor Code which prohibits the issuance of any court of a preliminary or permanent inunction or TRO.</p><p>“Yung prayer namin is for the lower courts to desist from any proceeding which is illegal kasi it is our position that the proceedings being held therein is not proper because it is against the Labor Code,” Du said.</p><p>San Fernando also noted that because of the TRO, 1.1 million workers continue to lose P66 million per day.</p><p>The P85 wage hike is split into two tranches: P60 which took effect on July 25, while the final P25 increase will take effect on January 20, 2027.</p><p>“So ibig sabihin assuming ma-lift o mabasura iyong Temporary Restraining Order and the petition to suspend itong dagdag sahod dapat iyong mga manggagawa ay makuha ang kanilang dagdag sahod mula July 25, kung kailan na-implement iyong dagdag sahod,” San Fernando said.</p>
