MANILA -- The Department of Labor and Employment- National Capital Region conducted its ‘High-Impact, High-Visibility Inspection’ (HIHVI) in various construction sites and found that some have violated labor standards.Nearly 700 construction companies and projects were checked in the last few months covering over 15,600 construction workers. Compliance rate for the Occupational Safety and Health Standards (OSHS) was high at 83.09 percent, but this also means there are still firms which are non-compliant.“Ano yung mga violations? Number one is yung construction safety and health program- usually yung iba hindi nagkakaroon ng program. Required OSHS personnel such as yung ating mga safety officers, first aiders, also the provision of personal protective equipment,” said Niña Abryn Perez, DOLE-NCR Senior Labor and Employment Officer.Aside from these violations, she also noted that some sites lack signages, barricades and other electrical safety processes. There are also some lapses or issues with applicable wages for construction workers like a lack of overtime pay, holiday pay, and a lack of statutory benefits such as Social Security System coverage, PhilHealth and Pag-IBIG benefits.Joel Petaca, Director of DOLE-NCR Camanava Field Office, added that some construction sites do not have proper and separate barracks for the workers. He emphasized that construction workers should not sleep inside the constructed facility.“Isa sa mga nagiging problema diyan karamihan diyan natutulog mismo doon sa project area which is I think dapat di inaallow natin. Isa sa nakita nating violation.. Napakadelikado dahil hindi naman natin gustuhin pero minsan may mga aksidente, bigla nagco-collapse ang building,” Petaca said.DOLE-NCR said they have already reminded these erring companies, and they were given time to correct or improve their processes. However, construction firms that will still not comply will be sanctioned.“Ang OSHS law natin pero day ang penalties - ang bigat niyan. Talagang ‘uy umayos kayo, mabigat ito.’ Pag ang pag-usapan natin minimum wage, double indemnity yan, times two… Ang pinakamahirap diyan lalu na ang work stoppage order na issue natin,” said Jude Thomas Trayvilla, DOLE-NCR Assistant Regional Director.The National Union of Building and Construction Workers welcomed the efforts by DOLE-NCR to monitor construction sites for the welfare of the workers. The group hopes for more inspectors since there are only very few currently and they cannot monitor all project sites in a year.“Sa bawat may violation, ang nalalagay kasi sa alanganin ay mga manggagawa, hindi naman mga kumpanya,” said Santiago Nolla, Vice Chairperson of the National Union of Building and Construction Workers.DOLE-NCR said the HIHVI is a regular activity for them aimed to check and monitor companies. Its goal is not merely to punish construction companies but to work together with them for the benefit of workers.“This is a necessary activity. We look at it as a partnership na tulungan niyo kami na ma ano natin yung mga batas natin para sa kapakanan ng ating empleyado,” Trayvilla added.DOLE-NCR Director for Quezon City Field Office Rowella Grande added, “The department recognizes that the inspection is not solely punitive where deficiencies are identified, employers and contractors are given the opportunity to undertake appropriate corrective measures.”Inspections and monitoring continue even those who were deemed compliant. DOLE-NCR said construction sites changed quickly and there needs to be also continuous assessment to check the welfare of the construction workers.
