MANILA (UPDATED) – The Supreme Court has approved its Rules on Extradition Proceedings involving extraditees, which is set to take effect on November 10, 2025.Included in the set of rules are strict timelines, such as giving courts 30 days to render judgment from the date of presentation of the last witness.&quot;In case no witnesses are presented, the Extradition Court shall render judgment within 30 calendar days from receipt of the last pleading, or upon the expiration of the period for its filing,&quot; the SC said.The rules were promulgated in an en banc resolution dated April 8, 2025.The high court also said that a witness must be fully examined in one day.The court noted that an extradition request by a requesting State should be granted if a prima facie case exists showing that the petition complies with Philippine laws and the applicable Extradition Treaty, among others.&quot;Even if the terminology or the elements of the offense differ under the said laws, extradition can still be granted if the act is considered a crime in both countries and satisfy the elements of the offense in each jurisdiction,&quot; the Supreme Court release read. &quot;If the extraditee is wanted to serve a sentence of imprisonment or other deprivation of liberty, extradition will only be allowed if the remaining sentence to be served is at least six months,&quot; it added. <div><a class="fr-green fr-strong" href="https://www.abs-cbn.com/news/nation/2025/10/26/supreme-court-urged-to-set-time-limits-designate-special-courts-for-flood-control-cases-2244">READ: Supreme Court urged to set time limits, designate special courts for flood control cases</a></div>In case an appeal is filed before the Court of Appeals, it should be decided within 90 calendar days.&quot;The said decision shall be final and immediately executory,&quot; the SC said. On the custody of the extraditee, the SC noted that the extraditee arrested pursuant to a warrant of provisional arrest shall be detained at the National Bureau of Investigation facility. &quot;In the absence of such a facility, the extraditee shall be detained at the appropriate detention facility nearest to the said court,&quot; the SC said.It also added that the act of extradition can begin if the Justice secretary or any &quot;designated authorized state counsels&quot; of the Office of the Chief State Counsel files a verified petition with the extradition court. &quot;Once filed, that court has exclusive jurisdiction over the case, even if the extraditee moves to a different location or residence,&quot; it said.
