MANILA -- The Supreme Court has affirmed the decision of the Sandiganbayan to forfeit the properties, bank deposits and investment accounts of the heirs of the late Armed Forces of the Philippines comptroller Jacinto Ligot.The high court’s 3rd Division noted in its decision that Ligot died during the pendency of his petition questioning the decisions of the Sandiganbayan on the two forfeiture cases.The court noted that under Republic Act No. 1379 or Forfeiture Law, there is presumption that properties of a public official were unlawfully acquired if the amount is out of proportion to his salary.“Applying the foregoing to the present cases, the SBN (Sandiganbayan) correctly ruled that the evidence adduced by the Republic was sufficient to establish the prima facie presumption that the properties subject for forfeiture were unlawfully acquired by General Ligot,” the court said in the decision penned by Associate Justice Japar Dimaampao.Ligot’s Civil Case No. 0197 involved Ligot, his wife Erlinda and children Paulo, Riza and Miguel, as well as his sister Miguela Ligot-Paragas and brother-in-law Edgardo Tecson Yambao.A lifestyle check conducted by the Office of the Ombudsman determined that Ligot&#x27;s funds and properties approximately valued at P135 million were acquired unlawfully.Among the properties were raw land in Tanay, Rizal worth P2 million, a unit in Essensa East Forbes Condominium Lawton Tower worth P25 million, Armed Forces and Police Savings and Loan Association funds amounting to P7.4 million, a building in Malaybalay City worth P6.7 million, two houses in California worth P33 million each.Ligot’s sister and brother-in-law had asserted that they owned the questioned condominium units but the Supreme Court rejected the claims.  The court also noted that Ligot’s income from his salary and other legitimate sources, coupled with his wife’s salary amounted to only P6.6 million.The court also stated that Ligot’s children did not have their own independent sources of income at the time and yet their AFPSLAI accounts were worth P200,000 to P420,000.“Undoubtedly, the amassed wealth worth P53,852,941.13 is manifestly disproportionate to the family&#x27;s lawful income and is presumed unlawfully acquired under Republic Act No. 1379,” the court said.
