Nicolas Tucat,  AFP</span></span></span></div><p>MANILA<strong> (2nd UPDATE) </strong>— The Supreme Court has granted the manifestation of Solicitor General Darlene Berberabe to represent the government in the pending petitions of the camp of former President Rodrigo Duterte on issues concerning the International Criminal Court.</p><p>In a statement, the high court said the en banc acted on the <a href="https://www.abs-cbn.com/news/nation/2025/12/2/new-solgen-re-enters-appearance-in-duterte-and-dela-rosa-petition-in-supreme-court-1432">manifestation filed by Berberabe</a> during its December 3, 2025 session.</p><p>“The SC granted the Manifestation with Entry of Appearance filed by the Office of the Solicitor General (OSG), allowing the OSG to resume its role as counsel for the respondents in the case,” the SC said.</p><p>Berberabe re-entered the appearance of the OSG following the recusal of former solicitor general Menardo Guevarra.</p><div><br/></div><div><strong>DUTERTE CAMP: GUEVARRA GOT IT RIGHT THE FIRST TIME </strong></div><div><br style="caret-color:rgb(0, 0, 0);color:rgb(0, 0, 0)"/></div><p>For the camp of Veronica “Kitty” Duterte, it does not matter who represents the government in the various petitions pending before the Supreme Court on the arrest and transfer of her father, the former president. </p><p>Atty. Israelito Torreon reiterated their position that there is no extradition treaty with the Netherlands, where the ICC is headquartered, to justify Duterte&#x27;s transfer there.</p><p>Torreon cited Section 17 of the Philippine Act on Crimes Against International Humanitarian Law, Genocide, and Other Crimes Against Humanity, which holds that the government &quot;may surrender or extradite suspected or accused persons in the Philippines to the appropriate international court, if any, or to another State pursuant to the applicable extradition laws and treaties.&quot;</p><p>He maintained that with the Philippines&#x27; withdrawal from the Rome Statute and the ICC in 2019 &quot;no treaty or agreement exists with the ICC on the surrender or turnover of persons.&quot;</p><div><a href="https://www.abs-cbn.com/news/nation/2025/3/16/duterte-arrest-illegal-palace-says-there-was-basis-in-domestic-law-1501"><strong>Duterte arrest &#x27;illegal&#x27;?
