MANILA — Human rights lawyer Neri Colmenares on Tuesday listed 3 possible places where former President Rodrigo Duterte may be held if he is brought out of the country due to a pending complaint for crimes against humanity before the International Criminal Court (ICC)

Colmenares, a former party-list lawmaker, who serves as counsel for victims of extrajudicial killings in the drug war during the Duterte administration, said President Ferdinand Marcos Jr can authorize the execution of a warrant of arrest once issued by the ICC. 

“It is possible that he will be spirited out of the country,” Colmenares said in an ANC interview. 

“Under the rules of the ICC, once an arrest order is issued, it is up to the ICC saan dadalhin ang akusado," he added.

He said there are 3 possible places where Duterte may be detained if he is brought out of the country. 

“Under the rules of the ICC, once an arrest order is issued, it is up to the ICC saan dadalhin ang akusado,” Colmenares said. 

“One pwede siyang makulong sa kustodya ng ICC. Two, pwede sa third party.  Or 3, sa the Hague mismo. Either of the 3 nasa poder ng ICC. It will be up to ICC where he will be detained," he added.

Duterte flew to Hong Kong over the weekend to attend the “Pasasalamat kay PRRD” event, a gathering for overseas Filipino workers to meet the former president, Vice President Sara Duterte and the senatorial candidates they were endorsing for the 2025 midterm elections.  

The Presidential Communications Office earlier confirmed Interpol Manila had received an ICC warrant for Duterte’s arrest. The Prosecutor General served the warrant upon Duterte’s arrival at the NInoy Aquno International Airport at 9:20 a.m. Tuesday.

Duterte is currently under the custody of the Philippine National Police, the PCO said, adding the former president is in good health and is being examined by government doctors. 

Bryony Lau, Human Rights Watch Deputy Asia Director, said Duterte’s arrest is “a critical step for accountability in the Philippines.” 

“Duterte is facing charges of crimes against humanity in relation to thousands of extrajudicial killings in his ‘war on drugs’ between 2011 and 2019. His arrest could bring victims and their families closer to justice and sends the clear message that no one is above the law. The Marcos government should swiftly surrender him to the ICC,” Lau said in a statement.
