MANILA — The Commission on Elections First Division on Thursday dismissed the second petition that sought to disqualify ACT-CIS Party-list Rep. Erwin Tulfo from May's Senate race.

Petitioner Bertini Cataluna Causing failed to submit proof that Tulfo received the petition, the Comelec First Division said in a March 11, 2025 order.

“Upon scrutiny of the submitted Petition and its attachments, it appears that the Petitioner failed to submit proof of service of the Petition with complete annexes to the respondent or an affidavit of service….Hence, it cannot be ascertained whether the respondent received a copy of the petition with complete annexes,” the Comelec said its its 3-page order..

Causing’s petition had cited Tulfo’s conviction on four counts of libel and his citizenship issue.
