<div><img src="https://od2-image-api.abs-cbn.com/prod/editorImage/174196041114220250314_Main_Duterte Case Dismissed.jpg" class="fr-fic fr-dib"/></div>Hindi totoong ibinasura ang kasong crimes against humanity na kinahaharap ngayon ni dating Pangulong Rodrigo Duterte sa International Criminal Court (ICC) kaugnay ng madugo niyang drug war.Kumalat ang maling impormasyon sa social media matapos maaresto si Duterte noong Marso 11, 2025 at inilipad sa The Hague, Netherlands kung nasaan ang headquarters ng ICC.Dalawang materyal ang ginamit na basehan para sabihing dismissed na ang kaso ni Duterte.Una, gumamit ang ilang post ng <a href="https://www.youtube.com/watch?v=-n2nd0QRRgQ" rel="noopener noreferrer" target="_blank">dating report</a> tungkol sa pagbasura ng ICC sa apela ng Pilipinas at nilagyan ng mga caption gaya ng “DINISMISSED MG ICC ANG CASE LABAN KAY FPRRD.” Pangalawa, ginamit ang livestream ng pro-Duterte vlogger na si Sass Rogando Sassot kung saan ipinagtanggol niya si Duterte. Saad ni Sassot, nalabag umano ang Article 59 ng Rome Statute noong inaresto si Duterte dahil hindi siya dinala sa korte ng Pilipinas bago inilipad. Ang Rome Statute ay isang kasunduan na nagtatag sa ICC.Sa unang claim, hindi ang kaso ni Duterte ang ibinasura ng ICC kundi ang petisyong nais magpahinto sa imbestigasyon sa kanyang madugong drug war.<div><a href="https://www.abs-cbn.com/news/2024/10/31/fact-check-hindi-apela-para-ipaimbestiga-si-duterte-ang-binasura-ng-icc-1736" rel="noopener noreferrer" target="_blank">FACT CHECK: Hindi apela para ipaimbestiga si Duterte ang binasura ng ICC</a></div>Batay sa <a href="https://www.icc-cpi.int/sites/default/files/CourtRecords/0902ebd18051fd37.pdf" rel="noopener noreferrer" target="_blank">desisyon</a> ng Appeals Chamber noong Hulyo 18, 2023, mayroong hurisdiksyon ang ICC sa mga kaso ng pagpatay na naganap mula Nobyembre 1, 2011 hanggang Marso 16, 2019. Sa mga panahong ito, bahagi o State Party pa ang Pilipinas ng Rome Statute, at dahil dito ay ipinagpatuloy ang imbestigasyon. Nagsilbing vice mayor ng Davao City si Duterte mula 2010 hanggang 2013 at bumalik sa pagka-mayor noong 2013, pagkatapos ay naging pangulo mula 2016 hanggang 2022.Sa pangalawang claim, nagkaroon ng diskusyon sa pagitan ng mga ligal na eksperto kung umiiral ba ang Article 59(1) ng <a href="https://www.icc-cpi.int/sites/default/files/2024-05/Rome-Statute-eng.pdf" rel="noopener noreferrer" target="_blank">Rome Statute</a> sa sitwasyon ni Duterte dahil umalis na ang Pilipinas sa nasabing kasunduan. Noong Marso 17, 2018 ay nagpasya si Duterte na umalis sa Rome Statue matapos ipahayag ng ICC na uumpisahan ang imbestigasyon sa kanyang drug war; naging epektibo ito noong Marso 17, 2019.Batay sa nasabing probisyon ng Rome Statute, kailangan dalhin ang akusado sa korte ng custodial State Party bago ilipat sa ICC: “A State Party which has received a request for provisional arrest or for arrest and surrender shall immediately take steps to arrest the person in question in accordance with its laws and the provisions of Part 9.&quot;“Kailangan pagdesisyunan ng Philippine government kung ano yung posisyon mo dyan (sa pagdala kay Duterte sa lokal na korte) kasi maraming provision under the Rome Statute applies only to state parties,” <a href="https://youtu.be/253LfwQHP6s?t=1105" rel="noopener noreferrer" target="_blank">paliwanag</a> ni Michael Tiu Jr., isang propesor sa University of the Philippines College of Law.Pero dagdag niya, iniaayon lang din ng Rome Statute ang sistema ng pag-aresto sa pambansang batas ng Pilipinas.Pero kahit na hindi nasunod ang tamang paraan ng pag-aresto, mananatili pa rin ang hurisdiksyon ng ICC sa kaso ni Duterte.“The tribunal will continue to have jurisdiction even if the accused was wrongfully arrested because the arrest doesn&#x27;t have to do with the tribunal,” <a href="https://youtu.be/cBvI_3_xBUk?t=225" rel="noopener noreferrer" target="_blank">paliwanag</a> ni former Supreme Court Associate Justice Antonio Carpio.Tinatawag na “male captus, bene detentus” ang legal principle na ito at <a href="https://www.icc-cpi.int/sites/default/files/CourtRecords/CR2006_02991.PDF" rel="noopener noreferrer" target="_blank">alinsunod</a> ito sa sistema ng international courts kabilang ang ICC.Itinakda ang <a href="https://www.icc-cpi.int/sites/default/files/CourtRecords/0902ebd180af88ae.pdf" rel="noopener noreferrer" target="_blank">unang pagharap</a> ni Duterte sa Pre-Trial Chamber I noong Marso 14, 2025.
