BH party-list says it violated no election laws, files urgent motion for proclamation

MANILA — The Bagong Henerasyon party-list said Thursday it has filed an urgent motion for its proclamation as it insisted it did not violate any election laws.

The Commission on Elections suspended the proclamation of the Bagong Henerasyon and Duterte Youth party-lists due to pending disqualification petitions.

Rep. Bernadette Herrera-Dy of the BH party-list told TeleRadyo Serbisyo that she believes the Comelec could dismiss the petition against her group "outright" because it did not break any election laws.

Herrera-Dy said BH will exhaust all legal remedies with the Comelec first and it would be "too premature" to seek relief from the Supreme Court because they have not received a copy of the complaint.

Meanwhile, Comelec chairman George Garcia said a Comelec division is now assessing the merits of the case and could dismiss it outright if the petitioner failed to provide BH a copy of the complaint.

"Obligasyon ng petitioner 'yung pagbibigay ng kopya sa respondents. Kung sa simula pa lang, walang pagbibigay ng kopya bakit pa tayo aabot sa merit, idi-dismiss na agad natin 'yung kaso," he said.

(It is the petitioner's obligation to give respondents a copy. If they did not, there is no reason to go into the merits. We will dismiss it immediately)

The Comelec has vowed to resolve the issue surrounding the Duterte Youth and BH party-list groups before the 20th Congress opens on June 30.
