<p>MANILA — There is nothing irregular with the move of the Senate impeachment court to remand the Articles of Impeachment against Vice President Sara Duterte to the House of Representatives, impeachment court spokesperson Reginald Tongol, a lawyer, said.</p><p>He called the unprecedented move an “action of liberality” that the Senate did &quot;instead of using the power to have it dismissed&quot; over issues raised by some senators.</p><p>“So, walang impropriety doon, it is normal in a collegial judicial body na ganoon na nangyayari because one of the powers, inherent powers of any court is to look into the face of the document, the complaint itself and see if there are defects in that document,” he added.</p><p>This was in response to former Senate president and Senator-elect Vicente “Tito” Sotto III, who called the Senate impeachment court&#x27;s decision “flawed” as he pointed out senator-judges “cannot file a motion on himself.&quot; </p><p>He said only the defense and prosecution panels can do that.</p><p>For Christian Monsod, a lawyer and one of the framers of the 1987 Constitution, the Senate as an impeachment court should not have remanded the articles of impeachment to the House, as they have no responsibility to determine its constitutionality.</p><div><a href="https://www.abs-cbn.com/news/nation/2025/6/10/sara-duterte-impeachment-trial-in-limbo-after-senate-returns-case-to-house-expert-0727">Sara Duterte impeachment trial ‘in limbo’ after Senate returns case to House: expert</a></div><p>“They did not have to do that because &#x27;yung issue, ultimately, is issue that is for the Supreme Court to decide,” he said in an interview with DZMM Saturday, June 14.</p><p>“’Yung constitutionality of the fourth charge, that is an issue that they cannot go into. They don’t have the power to determine the constitutionality of the fourth impeachment charge.
