MANILA — The Commission on Elections (Comelec) said the fate of former president Rodrigo Duterte as Davao City mayor is no longer within the jurisdiction of the commission but with the Department of the Interior and Local Government (DILG).According to Comelec Chairman George Garcia, as long as local winning candidates have no pending case before the commission, their jurisdiction will be transferred to the DILG. “Ang Comelec po ay basta naproklama na (candidates) at wala namang case sa samin na naka-pending - ang jurisdiction po ay wala na sa amin. Basta walang kaso sa amin, walang naka-pending…kaagad na nag jurisdiction ay malilipat sa DILG. Lalo na pagdating ng June 30…so kung sino ngayon ang uupo yan ay call na ngayon ng DILG,” Garcia said.Under the rule of succession, Garcia said,  it is the proclaimed vice mayor who will serve as the acting mayor. “Yes by operation of the law of the Local Government Code. “Pag tiningnan n’yo po ang Section 39, Section 43, Section 44 ng Local Government Code - makikita n’yo dun meron permanent incapacity, temporary incapacity, merong rule on succession,” he explained.The Comelec chief said a winning candidate who is outside the country can take his oath before an ambassador or Philippine Consul General. “Walang nakalagay sa ating batas kung saan pupuwedeng mag-oath ang isang tao. Kalimitan ‘pag nasa abroad ang isang tao…nag-o-oath tayo dun sa ating embahada - either sa ambassador o sa isang consul natin at pagkatapos yung mismong dokumento na pinapanumpaan natin ay humihingi ng tinatawag na apostile,”  said Garcia.“Wala ring nagsasabi kung paano yung pag-oath eh…kasi remember kapag ambassador o yung consul - ang jurisdiction nila ay yung lugar kung saan sila naka-assign,” he added.Duterte was arrested on March 11  on his arrival from Hong Kong at the request of the International Criminal Court (ICC) as part of its probe into his &quot;war on drugs&quot; that defined his presidency.The ICC warrant for Duterte&#x27;s arrest said that as president, the 80-year-old Duterte allegedly created, funded, and armed death squads that carried out murders of purported drug users and dealers.He was brought to The Hague in the Netherlands on the same day he was arrested.Duterte on March 14 appeared via video link before ICC judges.
