Alan Peter Cayetano’s resolution seeking the house arrest of former President Rodrigo Duterte as he awaited possible trial for alleged crimes against humanity, a lawyer representing victims of alleged killings in his drug war said Friday. </p><p>The bid for Duterte’s interim release from ICC detention is a matter that should be tackled by prosecutors, the defense, and the judges, said rights lawyer Kristina Conti.</p><p>“Hindi para sa Senado ang maghanap ng compromise,” she told DZMM. </p><p>“Una, mayroon bang kapasidad, may awtoridad ba, kikilalanin ba itong resolusyon na ito ng ICC? Sa puntong ito, hindi — actually sa kahit anong punto hindi kikilalanin ng ICC ang ganitong resolusyon na parang nangingialam sa kaniyang mga proseso,” Conti added.</p><div><a href="https://www.abs-cbn.com/news/nation/2025/7/8/icc-prosecutor-submits-12th-batch-of-evidence-vs-duterte-1638">ICC prosecutor submits 12th batch of evidence vs Duterte</a></div><p>Cayetano’s resolution cited “Duterte&#x27;s deteriorating health, attributed to old age and prolonged social isolation, warning that continued detention may severely impact his emotional and physical well-being,” according to a press release from his office. </p><p>But Conti noted that the resolution appeared to have no proof of Duterte’s medical status. </p><p>“Mahirap naman po na isang third party pa nga. Walang kinalaman si Senator Alan Peter Cayetano sa sitwason ni Duterte ngayon, walang pruweba na nakabisita siya at puro hearsay kumbaga ang kaniyang basehan,” Conti said. </p><p>“Sa appreciation ng ICC, okay po sana kung mayroong facts to appreciate. Pero dito, wala. Mas lumalabas pa nga na ito ay political posturing ng one branch of government,” she said.  </p><div><a href="https://www.abs-cbn.com/news/nation/2025/6/24/icc-prosecutor-opposes-duterte-s-request-for-interim-release-1649" rel="noopener noreferrer" target="_blank">ICC prosecutor opposes Duterte’s request for interim release</a></div><div><strong>&#x27;NOTED&#x27; </strong></div><p>Meanwhile, Malacañang acknowledged Justice Secretary Jesus Crispin Boying Remulla&#x27;s opposition to calls for Duterte&#x27;s interim release when asked for comment on Cayetano&#x27;s resolution.</p><p>In an interview with ANC&#x27;s Headstart last month, Remulla said Duterte&#x27;s interim release was &quot;not appropriate&quot; and could cause more harm than good.</p><p>&quot;Nagsalita na po ang ating SOJ Boying Remulla patungkol po sa interim release. At kung may ganiyan pong mga suggestions mula kay Senator Alan Cayetano, noted,&quot; Castro said.</p><div><strong>SOLONS REACT</strong></div><p>A leader of the 19th Congress House Quad Committee and a party list solon also expressed doubts on Friday that the International Criminal Court would accommodate a Senate Resolution seeking the house arrest of former President Rodrigo Duterte, as he awaits possible trial for alleged crimes against humanity.</p><p>ACT Teachers Party List Repesentative Antonio Tinio said “the ICC will only consider interim release to a member state”.</p><p>He asked Sen. Alan Peter Cayetano, who filed the resolution, if he is expecting special treatment for Duterte.</p><p>“Yet another senator playing to the gallery, telling Duterte supporters what they want to hear to rally the faithful and keep them agitated… Too bad for him now, since Duterte himself caused the Philippines to withdraw from the ICC. Or does the senator expect special treatment for Duterte from the ICC? In which case it’s not going to happen,” Tinio said in a statement.</p><p>Manila 6th District Representative Bienvenido Abante Jr. noted that the ICC has yet to rule on the application for Duterte’s interim release, which was formally opposed by an ICC prosecutor.</p><p>“The resolution does not have any bearing at all dahil ‘yung resolution naman is asking the Philippine government, ‘di ba? And the request should come from the Philippine government kung ipapagamit nila ‘yung ating embassy doon sa Netherlands para ‘yung ating dating Pangulo ay doon siya mag-stay. So, I believe that Sen. Alan would have the right to file any resolution. Yet sa akin, I don&#x27;t think there is any bearing on that as far as the ICC is concerned,” he said.</p><p>“It remains to be seen kung ‘yan ay aprubahan ng ating pamahalaan. As far as I&#x27;m concerned, kahit na po siguro ang ating paamahalaan ay mag-request sa Netherlands about that. I do not know if the ICC would listen, sapagkat palagay ko mukhang hindi na yata pinakinggan ‘yung petition ng kampo ni dating Pangulo na siya ay ilagay sa isang o itangkilik ng ibang bansa. So kung ‘yan ang nangyari, I don&#x27;t think that the ICC would also try to accommodate him on that,” Abante added.</p><p>“I do not have any problem with that, actually. If the government will be able to justify that resolution, baka maaari. Sa akin, medyo okay na rin kung halimbawa he&#x27;ll be staying at the embassy ng Pilipinas for health consideration…I think the Philippine Embassy also has a perhaps a mandate to help a Filipino abroad, on that consideration.
