Maria Tan, ABS-CBN News </span></span></span></div><p>MANILA — A group of lawyers filed a petition for certiorari and prohibition in another bid to halt the hearings of the House Committee on Justice on the impeachment complaints against Vice President Sara Duterte.</p><p>In their petition dated April 20, 2026, lawyers Hue Jyro Go, Micah Lorelle De Guzman and Jake Leoncini asked the high court to issue a temporary restraining order or a writ of preliminary injunction against committee chairperson Gerville Luistro and House Speaker Faustino Dy, III.</p><p>This is the fourth petition to be filed before the Supreme Court, including<a href="https://www.abs-cbn.com/news/nation/2025/2/19/sara-duterte-challenges-her-impeachment-at-supreme-court-1053"> that of the Vice President herself.</a> </p><div><a href="https://www.abs-cbn.com/news/nation/2026/4/22/ombudsman-sara-duterte-saln-house-panel-impeachment-1050">Ombudsman submits Sara Duterte SALNs to House panel </a></div><p>Go, De Guzman, and Leoncini alleged that the continuing acts of Luistro and Dy were in excess of their constitutional and procedural authority, resulting in irreparable injury. </p><p>“In the present case, the continuing acts of respondents - particularly the issuance and implementation of subpoenas, compulsory processes, and evidentiary directives-are not mere procedural incidents but affirmative acts that irreversibly alter the character of impeachment proceedings from a constitutionally limited threshold evaluation into an unauthorized investigative and quasi-inquisitorial process,” the petitioners said.</p><p>They also warned that unless the respondents are immediately restrained, the respondents would continue to enforce subpoenas for personal and financial records, including Statements of Assets, Liabilities and Net Worth. </p><p>“The power to initiate is not the power to investigate without limit, to search for offenses not sufficiently pleaded, or to compel evidence in order to cure defects in a complaint that should have stood or fallen on its face,” the petitioners said.</p><p>Aside from a TRO, the petitioners asked the high court to annul and set aside the committee’s rulings, directives and other proceedings, including the findings of <a href="https://www.abs-cbn.com/news/nation/2026/3/4/house-panel-sara-duterte-impeachment-complaint-sufficient-in-substance-1403">sufficiency in form and substance </a>of the two impeachment complaints.</p><div><a href="https://www.abs-cbn.com/news/nation/2026/4/22/third-house-impeachment-hearing-focuses-on-sara-duterte-s-wealth-0800">Sara Duterte&#x27;s alleged unexplained wealth is focus of 3rd House impeachment hearing</a></div><div><span class="fr-video fr-deletable fr-fvc fr-dvb fr-draggable" contenteditable="false" draggable="true"><iframe width="640" height="360" src="https://www.youtube.com/embed/1BW4UTRf5EI?&amp;wmode=opaque&amp;rel=0" frameBorder="0" allowfullscreen="" class="fr-draggable"></iframe></span><br/></div>
