MANILA — A defense counsel questioned on Monday the supposed “converted” received date on the investigation data form, which the National Bureau of Investigation filed before the Department of Justice regarding alleged grave threats and inciting to sedition complaints against Vice President Sara Duterte.Atty. Mark Vinluan showed a photo of the document, and pointed out that it appears to have been initially stamped received on February 12, 2025, but there was a manual mark on top of the date “converting” it to January 30, 2025.Vinluan pointed out that the new date was before the House of Representatives’ February 5, 2025 filing of the Articles of Impeachment against Duterte.The prosecution’s second witness, NBI Regional Director Jeremy Lotoc, however, said he is not familiar with the lower chamber’s impeachment filing, and could not answer the defense counsel’s question regarding the date on the received stamp, because he delegated the filing of the investigation data form to the DOJ.“There is a stamp, Department of Justice received, but it appears that it was initially stamped February 12, 2025, but there is a marking, a manual marking, that converted it to January 30,” Vinluan said during Lotoc’s cross examination.“Hindi ako ang nag-file. May inutusan po ako,” Lotoc replied.“It is only the DOJ that has the authority to change the date,” Vinluan pointed out.“You ask the DOJ, sir. Wala ho akong idea dyan,” Lotoc suggested.“The date is important, because there was also… an impeachment complaint filed against VP Sara also on February 5, 2025,” Vinluan noted.“Hindi ako familiar doon sa filing ng impeachment,” Lotoc said.Vinluan also raised questions on the February 3 affidavit of NBI Senior Agent John Mark Calilung, which was submitted to the DOJ.He said it came before the February 5 DOJ certification, where the agency enumerated the documents it required the NBI to submit, including the said affidavit.“The date is February 3, 2025… You attached this affidavit prior to the February 5, 2025 certification,” Vinluan pointed out.“Ang makakasagot niyan si Calilung, kasi may attachments na kami during the first affidavit na nainclude na doon sa mga nirerequire ng prosecutor... gaya ng number one, there is no affidavit of the persons, who recorded the video entitled &#x27;VP Nov 23 presscon at Batasan through OBS&#x27;, when in truth and in fact, kasama nang inattach doon ‘yung affidavit of authentication doon sa unang affidavit,” Lotoc answered.“So you’re telling this court that the DOJ made this mistake?” Vinluan asked.“Not necessarily, your honor. Pwedeng hindi nakita ng prosecutor na nandoon,” Lotoc replied.Vinluan also pointed out an alleged “discrepancy” in the docket number on the NBI’s investigation data form and the DOJ certification, which Lotoc said should be addressed to the DOJ instead.Senator-judge Erwin Tulfo, meanwhile, asked whether the NBI inquired about the progress of the DOJ’s preliminary investigation into the alleged grave threats and inciting to sedition against Duterte.“Is it normal for the DOJ to conduct a preliminary investigation about over a year?..Hindi kayo nagtatanong sa kanila, ano ang problema, bakit hindi pa naisasampa sa korte?” Tulfo asked.“‘Pag ang referral nasa DOJ na, hands off na ho kami doon, sila na ang nagdedecide noon kung paano nila ipo-process ang dokumento,” Lotoc replied.
