Jeremy Lotoc, Regional Director of the National Bureau of Investigation–Bangsamoro Autonomous Region in Muslim Mindanao (NBI-BARMM) and former chief of the NBI Cybercrime Division, as he takes the stand during the impeachment trial of Vice President Sara Duterte at the Senate in Pasay City on Monday, July 13, 2026. <em>Maria Tan, ABS-CBN News </em></span></span></span></div><p>MANILA — National Bureau of Investigation Regional Director Jeremy Lotoc was questioned by senator-judges over “typographical errors&quot; in the documents presented in the impeachment trial of Vice President Sara Duterte. </p><p>Lotoc, a lawyer and current chief of the NBI Bangsamoro, is the second witness the prosecution presented on the fourth article of impeachment. </p><p>He headed the NBI&#x27;s cybercrime division in 2024 when Duterte issued the alleged grave threats against President Ferdinand Marcos Jr., First Lady Liza Marcos and former House speaker Martin Romualdez. </p><p>Senator-Judge Alan Peter Cayetano first raised concern over an error in the agency’s affidavit of investigation, which he said stated that Duterte “resigned as the secretary of the Department of Justice…”</p><p>“That’s a typo, Your Honor,” Lotoc said in response. </p><p>Cayetano said the error was not just typographical since &quot;Department of Justice and Department of Education are two different things.”</p><p>Duterte served as the education secretary from June 2022 to July 2024, the period when DepEd&#x27;s confidential and intelligence funds were allegedly misused.  </p><p>Senator-Judge Imee Marcos later asked why the NBI issued a subpoena dated Nov. 6, 2024 to a media personality, despite saying the cybercrime team was ordered to investigate after the Nov. 23, 2024 press conference.</p><p>“Nov. 6, 2024, a subpoena was issued to ABS-CBN requiring them to submit an authenticated copy of the video pertaining to the 18 October presscon,” Marcos said reading NBI’s affidavit of investigation. </p><p>Aside from the Nov. 23 video, the NBI has said that it also discovered a video of Duterte making the alleged threats on Oct. 18, 2024. </p><div><a href="https://www.abs-cbn.com/news/nation/2026/7/13/nbi-exec-jeremy-lotoc-testifies-before-senate-impeachment-court-1514">NBI exec says Duterte&#x27;s alleged grave threats &#x27;serious and real&#x27;</a></div><p>Marcos asked whether that meant the NBI was already keeping an eye on and investigating Duterte before the November 23 press conference.  </p><p>“No, Your Honor. I believe that’s a typo, yung date,” Lotoc responded. </p><p>Upon checking the original subpoena, Lotoc said: “Date ng subpoena, Your Honor, is 6th day of November 2024, which I believe this is a typo kasi magkakasunod ho ito doon sa mga in-issue-han namin na media personalities.”</p><p>(The date of the subpoena, Your Honor, is 6th day of November 2024, which I believe is a type because the subpoenas for media personalities were sent out one after the other.)</p><p>Both the subpoena and the affidavit of investigation stated Nov. 6, 2024, Marcos said. </p><p>The affidavit was prepared by Lotoc&#x27;s team, he said.</p><p>“Kami ho ang nagtulong-tulong mag-draft ng affidavit of investigation, kung ano yung legal basis namin. And then we agreed and concluded na ito iyon, ito iyon,” Lotoc said.</p><p>(We drafted the affidavit of investigation together, what our legal basis was.
