<div><span class="fr-img-caption fr-fic fr-dib" style="width:960px;display:block" width="960"><span class="fr-img-wrap"><img src="https://od2-image-api.abs-cbn.com/prod/editorImage/178486170784420200219-sandganbayan-headquarters-JC-1035.jpg" style="width:960px" class="fr-fic fr-dib" width="960"/><span class="fr-inner" style="text-align:left">The Sandiganbayan building in Quezon City on February 19, 2020 Jonathan Cellona, ABS-CBN News</span></span></span></div><p>MANILA — The Sandiganbayan Sixth Division on Friday convicted former Department of Agrarian Reform (DAR) undersecretary Jerry Pacturan and detained businesswoman Janet Lim Napoles of 10 counts each of malversation over the alleged diversion of P50 million intended for farm input assistance.</p><p>The anti-graft court, chaired by Associate Justice Sarah Fernandez, sentenced Pacturan to a prison term of around 14 to 19 years for each count of malversation. He was also perpetually disqualified from holding public office.</p><p>Napoles was also convicted of 10 counts of graft, while Pacturan was acquitted of the graft charges for failure of the prosecution to prove his guilt beyond reasonable doubt.</p><p>They were both ordered by the court to reimburse P50 million to the National Treasury.</p><p>Pacturan was given 5 days to post a surety bond for his provisional liberty as he avails post-conviction legal remedies.</p><p>State prosecutors alleged that 10 local government units (LGUs) in Luzon were falsely made to appear as having requested farm input assistance to be implemented by 10 Napoles-linked non-government organizations using DAR regular funds.</p><p>Under the project, each LGU was supposed to receive P5 million to purchase farm inputs.</p><p>During the trial, prosecutors presented eight mayors from Pangasinan, Bulacan, Quezon and Batangas, among other provinces, who testified that their signatures on project documents had been forged.</p><p>The prosecution said Pacturan signed the memoranda of agreement with the NGOs on behalf of the DAR, which allowed the release of the funds.</p><p>Some of the NGOs involved were headed by Evelyn de Leon, who was sentenced to 10 to 12 years in prison for each of three graft convictions and 14 years, 8 months and 1 day to 19 years, 1 month and 11 days for each of three malversation convictions.
