MANILA — As the impeachment trial of Vice President Sara Duterte enters its 14th day, the House prosecution acknowledged the challenge of discussing the technical and legal aspects of the confidential fund allegations without losing public engagement.“Dahil sa nature ng pinag-uusapan natin dito confidential funds, hindi natin maiwasan, madami talagang matagal mga dokumento, libo-libo yung pinaguusapan dito,” House prosecution spokesperson Atty. Jay Tolosa said in a press briefing on Tuesday, August 11.“Isa sa challenge namin sa prosecution na mailatag ng mabuti ang ebidensya but at the same time, we also have to be aware of the fact that we should make sure that we’ll be able to capture the public’s attention,” Tolosa added.Part of the prosecution’s evidence is the presentation of thousands of acknowledgement receipts submitted by the OVP and the DepEd, which the defense refused to stipulate.<div>‘A FULLER PICTURE OF IRREGULARITIES’</div>The prosecution on Tuesday concluded its examination of its second COA witness, state auditor Xylene Del Campo.According to the prosecution spokespersons, aside from the new names appearing in the acknowledgement receipts, a key highlight of the testimony was the alleged physical impossibility of disbursing confidential funds across multiple locations on the same date.“Nakita na natin yung fuller picture kung gaano kalala yung irregularities, yung mga pangalan, yung mga petsa, at the physical impossibility to disperse yung ganun kadaming pera sa isang particular date sa ganung karaming lokasyon sa buong bansa,” House prosecution spokesperson Rep. Renee Co added.Joint Circular 2015-01, which governs the use of confidential funds, states that only the Special Disbursing Officer (SDO), and no third party, is authorized to disburse the funds. This was the basis for what Co described as the physical impossibility of the transactions.In relation to the disbursement of confidential funds, Del Campo also testified on Wednesday that the Commission on Audit (COA) issued a notice of disallowance, rather than a notice of suspension, following testimony from OVP SDO Gina Acosta that Duterte herself instructed them to hand over the funds to a third party.Tolosa highlighted the significance of the testimony, noting that it also pointed to Duterte’s accountability in the matter.“Ang naging tugon ng witness, bakit may papanagutan dito sa mga disallowed na mga use of confidential funds ang bise presidente? Dahil sabi niya, ang basis niya she allowed the use of these confidential funds,” he explained. “Si VP Sara ang mismong nag-utos sa kanila na ibigay ito sa third person…”<div>&#x27;SIYA LANG ANG MAKAKAPAGBIGAY NG PALIWANAG&#x27;</div>The prosecution maintained that its invitation for Duterte to attend the trial remains open, arguing that she is the only one who can directly explain the irregularities highlighted by the COA witness.“Yan ang isa sa mga rason bakit nananawagan ang mga kababayan natin, gusto natin marinig mismo galing sa Presidente,” Tolosa said.“That’s why standing pa rin yung invitation and even yung proactiveness sana ni VP Sara Duterte sa pagharap sa impeachment trial hearing na ito,” Co added.
