MANILA -- The Senate approved a bill seeking to exempt underprivileged and homeless individuals from the requirement to post a supersedeas bond to perfect an appeal in ejectment cases filed against them.A supersedeas bond is a bond that an appellant must post to temporarily halt the enforcement of a money judgment while an appeal is pending.Following a 19-0 vote, Senate Bill No. 70 seeks to provide stronger protection to vulnerable individuals facing the loss of their homes through ejectment proceedings by amending the Urban Development and Housing Act.“Lubos po akong nagpapasalamat sa ating mga kasamahan sa Senado sa pagpasa ng panukalang ito. Mahalaga ito para mabigyan ng patas na pagkakataon ang mahihirap nating mga kababayan na umapela sa korte kahit wala silang kakayahang magbayad ng supersedeas bond,” the bill’s sponsor, Senator Chiz Escudero, said.“Ito ay isang hakbang tungo sa mas makataong proseso sa usapin ng demolisyon at pagpapaalis,” he added.Instead of requiring a bond, courts may now accept a certificate of indigency instead issued by the barangay or similar documents. The certification, together with the appeal, would be sufficient to stay the execution of the judgment.“A certificate of indigency duly issued by the barangay, or other analogous documents therein, may be accepted by the courts in lieu of the required bond. The appeal together with the certificate of indigency or its equivalent document or documents should be sufficient for the courts to stay the execution of judgment,” the bill states.
