MANILA -- The camp of Vice President Sara Duterte is seeking to quash the grave threats information filed against her, citing “lack of jurisdiction.”“We confirm having filed a motion to quash the Grave Threats Information filed against the Vice President, on the ground of lack of jurisdiction,” Duterte’s counsel for her grave threats cases Atty. Paul Lawrence Lim said in a statement Thursday, August 13.“As lawyers bound by our Code of Professional Responsibility and Accountability, however, we cannot give any further discussion on this matter that is now sub judice. We thank the media and the public for their understanding,” he added.Lim previously said that the vice president is ‘confident’ that the charges against her ‘will ultimately be dismissed’.This comes after the Justice department confirmed that grave threats complaint against Duterte was filed Tuesday before the Quezon City Regional Trial Court.“Under prevailing circumstances, we have anticipated and prepared for such an outcome,” he earlier said, noting that the second-in-command “will exercise all available legal remedies in due course.”The National Prosecution Service of the Department of Justice confirmed the filing.Prosecutor General Richard Anthony Fadullon said the DOJ has been given five days to comment.“We just received information that the court had already received motions to quash coming from the defense and the prosecution was given a period 5-days within which to file its comment to  the same,” Fadullon told reporters.According to Fadullon, it will be up to the court how it will resolve Duterte&#x27;s motion.“I cannot speak for how the court will rule. However, we will be filing our comment as soon as we see what the basis is of  the defense in asking for the quashal of the information. Malalaman lang namin yan ‘pag nakakuha na kami ng kopya. Hindi namin masasabi kung ano ang grounds hangga&#x27;t hindi namin nakukuha yung kopya,” said Fadullon.Fadullon was also asked to comment on the statements made by Palace spokesperson Usec. Claire Castro who believes that inciting to sedition charges against Duterte should also be included.“I cannot try to determine the reasoning of the Palace spokesperson. However, we based it on the evidence that we have and based on the resolution itself - we had mentioned that it is not inciting to sedition…when these are just mere utterances or speeches when it is not proven that the accused or the defendant incited the people to rise publicly and tumultuously in order to achieved the ends mentioned,” Fadullon explained.<div> </div><div>IMPEACHMENT CASE</div>The prosecutor general believes the DOJ is not barred from filing charges against Duterte or any government official facing impeachment complaint.  “Whatever it is that going on before the Impeachment Court is different from the one we have now. This is before the RTC, that’s why we would leave it to the ruling of the court on how it will dispose the same whether it believes that the charges can be sustain then if the accused in this case is an impeachable officer,” according to Fadullon.“Kasi wala namang nagba-bar na hindi siya puwedeng file-an ng kaso - yun ang pananaw ng Department of Justice,” Fadullon added.
