The Prosecution of the International Criminal Court (ICC) has disclosed 6,909 items of evidence to the Defense team of former President Rodrigo Duterte in the crimes against humanity case against him.In a public notification dated August 5, ICC Deputy Prosecutor Mame Mandiaye Niang informed Trial Chamber III that the evidence was disclosed between January 7 and July 31, 2026. Of the total, 2,279 items were classified as “INCRIM,” or incriminating material that the prosecution may rely upon in pursuing its case.<div><a href="https://www.abs-cbn.com/news/nation/2026/7/30/vp-duterte-urges-icc-to-expedite-dad-s-trial-amid-detention-concerns-0646">VP Sara urges ICC to expedite Rodrigo Duterte trial over detention concerns</a></div>Another 4,573 items were disclosed under Rule 77 of the ICC Rules of Procedure and Evidence, which requires the Prosecution to allow the Defense to inspect material that is relevant to preparing its case or was obtained during the investigation. The remaining 57 items were classified as “PEXO,” referring to potentially exonerating material or information that may assist the defense. These included information that could undermine the credibility of a witness or suggest a possible line of defense.The actual evidence remains confidential and was listed in three annexes accessible only to the parties.<div><a href="https://www.abs-cbn.com/news/nation/2026/6/24/icc-trial-chamber-wants-rodrigo-duterte-to-appear-in-sept-7-status-conference-1202">ICC judge expects Duterte to attend Sept. 7 status conference</a></div>The filing showed that the incriminating material covered the alleged contextual elements of crimes against humanity, Duterte’s alleged modes of liability, and killings allegedly committed during his tenures as mayor of Davao City and president of the Philippines.The Prosecution organized the evidence into several areas, including killings allegedly linked to the Davao Death Squad during Duterte’s mayoral period, as well as operations against so-called high-value targets and barangay clearance operations during his presidency.The notification was submitted to Trial Chamber III, composed of Presiding Judge Joanna Korner and Judges Keebong Paek and Nicolas Guillou.
