Estrada filed four counts of perjury against Hernandez after he was implicated in anomalous “ghost” flood control projects during several probes conducted by both the lower and upper chambers of Congress. <em>Jonathan Cellona, ABS-CBN News/File</em></span></span></span></div><p>MANILA<strong> (UPDATE) </strong>— The Sandiganbayan Fifth Division granted detained Senator Jinggoy Estrada’s request to undergo a knee X-ray procedure at a private hospital in San Juan City on the morning of August 26.</p><p>In a minute resolution released on Monday, the anti-graft court allowed the lawmaker to visit the medical facility to address a flare-up of persistent pain in both knees. </p><p>Estrada has been detained at the New Quezon City Jail Male Dormitory in Barangay Payatas since June 1 as he faces plunder and graft charges over the alleged flood control kickback scheme. </p><p>According to his counsel, Estrada has previously been diagnosed with osteoarthritis and suffers from joint effusion in his knee joints, which reportedly made walking difficult for him.</p><p>His orthopedic doctor recommended the diagnostic X-ray to find out if his degenerative condition has worsened.</p><p>However, the prosecution argued that Estrada&#x27;s medical condition was not based on a direct clinical assessment or independently verified medical findings.</p><p>“The information regarding his alleged condition was merely relayed by his wife to his orthopedic doctor, rather than being personally reported by him or independently assessed and documented by a jail physician or through an independent medical examination. Thus, the purported medical condition appears to be based solely on a second-hand account,” read the opposition filed by the prosecution on Aug. 19. </p><p>“As such, the account is, at best, hearsay medical history and cannot be relied upon as sufficient medical evidence,“ it added.</p><p>The prosecution also suggested alternative options, including the use of mobile X-ray clinics at the jail facility or government-run medical facilities.</p><p>However, the court’s Fifth Division said it recognizes the accused&#x27;s health and well-being as a legitimate humanitarian concern.</p><p>Under the conditions set by the court, Estrada will leave the detention facility at 11:00 in the morning and must be returned by 3:00 in the afternoon on the same day. </p><p>The court, chaired by Associate Justice Zaldy Trespeses, mandated that all hospital bills and incidental expenses be borne entirely by Estrada. </p><p>It also ordered Jail Warden JSupt.
