Jonathan Cellona, ABS-CBN News/File</div>MANILA — The Sandiganbayan Special Second Division ordered Northstar Transport Facilities, Inc. and Northstar Shipping and Marine Services, Inc. to immediately vacate and surrender possession of the port terminal facilities located at Engineer Island in the Port Area, Manila.In a decision penned by Presiding Justice Geraldine Faith Econg, with the concurrence of Associate Justices Edgardo Caldona and Gener Gito, the anti-graft court granted the unlawful detainer complaint filed by the Bataan Shipyard and Engineering Co., Inc. (BASECO), which is represented by the Presidential Commission on Good Governance (PCGG) through the Office of the Solicitor General (OSG).The court ruled in its Aug. 17 decision that the defendants committed breaches of their monetary and non-monetary obligations under their lease contracts.It noted that although the defendants&#x27; initial possession was lawful, it became illegal “upon due notice of the termination of the lease” following defaults.&quot;The defendants evidently committed substantial breaches of contract in this regard, which justifies the rescission of the lease and now renders illegal their possession of the leased premises,&quot; the decision read.The court added that the defendants failed to fulfill their contractual obligations to modernize the facilities and equipment of the Manila Integrated Cargo Terminal (MICT) under a P450 million investment plan and to implement a corporate social responsibility (CSR) program.“Despite several demands for compliance, the defendants reneged on said contractual obligation. While the defendants now submit that the amount of investment for the modernization plan was never agreed to be deliverable in one tranche, the fact remains that they have failed to submit a Schedule of Investment and CSR Program as agreed upon and stated in the Fourth Lease Contract,” the court said.It ordered the defendants to pay the plaintiff P10.8 million of unpaid monthly amortizations under the compromise agreement from July 2024 to August 2026, and P6.89 million in back rentals covering March 2025 to August 2026. These are subject to a 6 percent annual legal interest until full payment.<div> </div>.
