MANILA (UPDATED) — The Office of the Ombudsman prosecutors asked Senior Associate Justice Ronald Moreno to voluntarily inhibit from the malversation case against former Sen. Ramon &quot;Bong&quot; Revilla Jr. over an alleged ghost flood control project in Pandi, Bulacan, citing his alleged prejudgment of prosecution witnesses and conduct that raised a &quot;perception of partiality.&quot;In a motion electronically filed on Monday, the prosecution claimed that Moreno allegedly exhibited &quot;unwarranted conduct&quot; against witnesses they presented in bail hearings and other court proceedings.  &quot;In particular, Justice Moreno&#x27;s demeanor and questions to the witnesses were apparently unfair, unreasonable, disrespectful, and lacking in judicial restraint,&quot; the motion read.<div><a class="fr-green" href="https://www.abs-cbn.com/news/nation/2026/8/4/bong-revilla-bail-sandiganbayan-judges-ombudsman-1035">RELATED: Sandiganbayan justices stand by bail ruling in Revilla’s malversation case despite criticism</a></div>The prosecution argued that Moreno&#x27;s line of clarificatory questioning and his public pronouncements also show that &quot;he might have already prejudged not only the credibility of the witnesses but also the credibility of their respective testimonies.&quot;It noted that these exchanges took place in open court in the presence of members of the press and other observers.The prosecution said its bid for Moreno&#x27;s inhibition was based on the circumstances of the proceedings and not an allegation of improper motive on his part.&quot;While the prosecution does not impute bad faith or improper motive on the part of the Honorable Associate Justice Ronald B. Moreno, there are, however, circumstances in the present case which reasonably give rise to a perception of partiality and cast doubt upon his ability to act with complete impartiality,&quot; the motion read.Moreno was one of the justices who <a class="fr-green fr-strong" href="https://www.abs-cbn.com/news/nation/2026/7/31/sandiganbayan-grants-revilla-s-bail-petition-for-malversation-1503">granted Revilla&#x27;s bail</a>.ABS-CBN News is reaching out to the court&#x27;s Third Division clerk of court for Moreno&#x27;s statement on the matter.The case that Revilla is facing is over <a class="fr-green fr-strong" href="https://www.abs-cbn.com/news/nation/2026/1/16/ombudsman-files-graft-charges-vs-revilla-dpwh-execs-over-bulacan-flood-project-1632">an alleged &quot;ghost&quot; flood control project in Pandi, Bulacan</a>.
