Jonathan Cellona, ABS-CBN News</div>MANILA — The Supreme Court affirmed the Commission on Audit&#x27;s disallowance of Flying Risk Pay to Civil Aviation Authority of the Philippines whose jobs were primarily managerial, administrative or financial in nature.In the decision of the en banc promulgated on January 21, the court cited Republic Act No. 776, or the Civil Aeronautics Act of the Philippines, which holds that CAAP-licensed airmen and other authorized personnel required to make regular and frequent flights in connection with their duties may receive an FRP equivalent to 50% of their salary for a minimum of four hours of flight time per month.“The disallowance itself is proper, as the payments lacked statutory basis and were granted to individuals who were not legally entitled thereto,” the court said in the decision penned by Associate Justice Henry Jean Paul Inting.The high court denied the petition for certiorari filed by CAAP officials and personnel who questioned the disallowance for the year 2011 with a total amount of P323,579.50.The officials and personnel argued that the head of office has the discretion to grant the hazard pay.The COA however insisted that the grant of the FRP is predicated on aerial and flight missions, which necessarily require the performance of duties inherent in aircraft operations. The court also however modified the COA decision holding the approving officers solidarily — or jointly — liable for the amount.The court said the recipients of the FRP are individually liable for the return of the disallowed amounts they respectively received.“Absent any showing of bad faith, malice, or gross negligence, the approving and certifying officers should be absolved from liability,” the court said.The court also stated in the decision that it is “respectfully requesting” Congress to revisit the law for the use of a more gender-fair language, noting the usage of terms such as “airman” and “airmen.”
